Ramsay Ordains: <br /> SECTION 1. AMENDMENT, <br /> Seclion 170.017L entilled "SITE PLAN <br /> REVIEW" and the first paragraph under the <br /> sobtitle "DEVELOPMENT CONTRACT" is <br /> amended to read as follows'. <br /> DEVELOPMENT CONTRACT <br /> Prior to approval of the site/building design <br />plan application and prior to construction of <br />any required site improvements, lhe applicant <br />shall enter into a contract with the City. This <br />cqntract shall require the applicant to construct <br />all improvements on the site at the applicant's <br />sole expense and in accordance with City plans <br />and specifications. Failure of the Developer lo <br />execute the Development Contract within 120 <br />days of site/design approval, shall require <br />submission of a new application by the appli- <br />cant. The Development Agreement shall pro- <br />vide that lhe Developer will deposit any re- <br />quired escrows with fha City prior to receipt of <br />any building permits and will complete all ii. <br />provemenfs permitted by the Development Con- <br />tract within one year of the date of site/building <br />design approval. Thereafter, the Council may <br />extend the period upon written application by <br />the Developer, subject to applicable perfor- <br />mance conditions and requirements, or the <br />Council may require submission of a new site/ <br />building design plan application. <br /> SECTION 2.
