								      acts or omissions shall be deemed violations of
<br />  the provisions of this code:
<br />   · Acts prohibited by Sections' 7.85.02 and
<br />   :.03 hereof;
<br />        A person who is required to submit infer-
<br />  'ion pursuant to subsection 7.85.05 and
<br />  engages in peddling, soliciting, transient mer-
<br />  chandising, or in making calls as described in
<br />  subsection 7.85.0t(2), without submitting such
<br />  information, or without payment of the license
<br />  fee required by subsection 7.01.t0, or does any
<br />  of the above before City Council approval of the
<br />  license as prescribed by subsection 7.85.05
<br />  hereof;
<br />      c. Furnishing false information, or failing to
<br />  furnish information as required by §27.85.05;
<br />      d. Sale of merchandise or services by a ped-
<br />  dler, solicitor, transient merchant or vendor by
<br />  means Of statements which the person making
<br />  them knows or should know are false or mis-
<br />  leading;
<br />     e. Sale of merchandise by a peddler, solicitor,
<br /> transient merchant or vendor, which merchan-
<br /> dise is not of merchantable quality or is not fit
<br /> for the purpose for which the seller knows,
<br /> has reason fo know, the merchandise is being
<br /> purchased;
<br />     f. Engaging in peddling, soliciting or transient
<br /> sales after the hour of 9:00 P.M. or before 9:00
<br /> a.m. unless a previous appointment has been
<br /> made.
<br />     7.85.07 Use of devices to attracl attention pro-
<br /> hibited. No person, licensed under this article,
<br /> shall call attention to his business or to his mer-
<br /> chandise by crying out, by blowing a horn, by
<br /> rit~ging a bell or by any loud or unusual noise.
<br />     7.85.08 Carrying and display. All licenses.
<br /> issued under this article shall be carr'ied by the
<br /> licensee or conspicuously posted in his place of
<br /> business and such licensee shall, whenever re-
<br />- quested, show the license to any officer or citi-
<br /> zen who demands to see the same.
<br />
<br />  7.85.09 Revocation. Any license may be
<br />           the City Council for a violation of
<br />  provision of this ordinance if the I censee
<br />
<br />                      reasonable notice and an op-
<br /> portunity to be heard.
<br /> SECTION 2. EFFECTIVE DATE
<br />    This Ordinance becomes effective thirty (30)
<br />days after its publication, subject to City
<br />Charter Section 5.07.
<br />    PASSED by the City Council of the C[ty of

<br />      The City of Ramsey Ordains:
<br />      SECTION 1. AMEND ~MENT                          ·
<br />
<br />  ' Amend Section 7.85 entitled Peddlers and So-
<br />  licitors to reed as follows:
<br />      7.85 Peddlers, Solicitors and Transienl Mer-
<br />  chants.
<br />      7.85.01 Definitions. For 1he purpOseS of this
<br />  section the words defined in this subsection
<br />  have the meanings given to them.
<br />      "Peddler" means any person with no fixed
<br />  place of business who goes from house to house
<br />  carrying Or transporting goo'ds, wares or mer-
<br />  ch~nd~s~ End Offering or exposing the same' for
<br />  sale, 0~' making sales and deliveries to pur-
<br />  chasers of the sa me.
<br />      "Solicilor~' means any poi'son Who goes from
<br />  house to house soliciting or taking or attemp-
<br />  ting tO take orders for the purchase of any
<br />  goods, wares or merchandise, including maga-
<br />  zines, books, periodicals or personal prope'rty of
<br />  any nature whatsoever"for delivery in the
<br />  future, -or etchers for' the .performance of
<br />  maintenance or repair services in or about the
<br />  home or place of business, such as furnace
<br />  cleaning, roof repair or blacktopping.
<br />      "Transient Merchanl" means any person,
<br />  firm or corporation who engages temPorarily in
<br />  the business of selling and delivering goods,
<br />  wares, or merchandise Within the City, and
<br />  who, in furtherance of such purpose, hires,
<br />  uses or occupies any building, structure,
<br />  ant 10t, motor vehicle, trailer, or railroad
<br />
<br />      Vendors of milk, groceries, bakery products,
<br />  or other perishable commodities, or vendors of
<br />  soft water service Or laundry and dry cleaning
<br />  pick-up and delivery, who make an uninvited in-
<br />  itiatory call upon the occupant of a residence as
<br />  a preliminary step to the establishment of a
<br />  regular route service for the sale and delivery
<br />  of such commodities or the providing of such
<br />  services to regular customers, shall not be in-
<br />  cluded within the above definition of "peddler"
<br />  or "solicitor".    ,
<br />      Peddler or solicitor does not include any per-
<br />  son who Selis or attempts to sell, or solicits or
<br />  attempts-to solicit orders for goods, wares or
<br />  merchandise,.if doing so on behalf of a bona
<br />  fide charitable, religious, civic, educational or
<br />  political Organizati6n.
<br />     7.85.02 Peddlers and solicitors may be Pro-
<br /> ,hibited by placard. Any resident of the City who
<br /> wishes:to exclude peddlers or solicitors from
<br /> premises, occupied by said resident may place
<br /> upon.: or hear the usual entrance to such
<br /> p~emisos a printed placard or sign bearing the
<br /> fei owing qotice: "Peddlers and Solicitors Pro-
<br /> hibited''. Such placard shall be at least 31/2 in-
<br /> cl!es Io[Ig and 31/2 inches wide and the printing
<br /> thereon ,shall 'not be smaller than 49 point type.
<br /> No peddler or solicitor shall enter in or upon
<br /> any premises~ orattempt to enter in or upon
<br /> any preffii~es,-.where such a placard or sign is
<br /> .placed and maintained.
<br />      7.85.03 M~y. not deface placard. No person
<br />  other than. the~person occupying such premises
<br />  shall remove; insure or deface such placard or
<br />  sign.
<br />      7.85.04 License required. A license shall be
<br />  required for any soliciting~ .peddling or tran-
<br />  sient merchandising, or 4n, making calls as
<br />O!ribed in §7.01 of this Chapter.
<br />  $.05 Application for license. In order to ac-
<br />  e the license required in Chapter 7.85.04, the
<br />  peddler, solicitor, transient merchant or ven-
<br />  dor, except a person selling or peddling the
<br />  products of a farm or garden occupied and
<br />  cultivated by themselves, must submit the fol-
<br />  lowing information to the City Adminislrator:
<br />      a. Name and permanent ~,ddress and .local
<br />  address, if any;
<br />      b. A brief descr_iption of the nature Of the
<br />  business and the'goods to be ~old;
<br />      c. If employed, the name and address of the
<br />  employer.
<br />  d. The period of time within which applicant
<br />
<br />   The source of supply of the goods or prop-
<br />        proposed to be sold, or in the case of goods
<br />      property to be sold by soliciation of orders
<br />  where such goods or products are located at the
<br />  time the information is submitted to the City
<br />  Administrator, the proposed method of delivery;
<br />      f. Any felonies m: gross misdemeanors, or any
<br />  crimes of theft or is~;uance of a worthless check,
<br />  of which the registrant was convicted within:the
<br />  .ten most recent years, and the nature of the
<br />  crime or crimes of which the registrant was
<br />  convicted; and
<br />      g. Whether the registrant has taken advan-
<br />  tage of any state or federal bankruptcy or in-
<br />  solvency law or proceeding as a bankrupt or
<br />  debtor within the ten most recent years. Every
<br />  peddler, solicitor or vendor required to submit
<br />  the foregoing information shall promptly sub-
<br />  mit to the City Administrator any changes
<br />  therein required by changes in circumstances·
<br />      h. In the case of transient merchants, the
<br />  place where the business is t9 be carried on
<br />  together with written consent of the property
<br />  owner of proposed Iocation~
<br />  i. A copy of County license..     .., .,
<br />  Every application shall bear the written
<br />  report and recommendation of the Chief
<br />  Police. No transient merchant license shall be
<br />  issued for sales from any location which does
<br />  not have sufficient parking for custon~ers and
<br />  for areas where customer parking would in-
<br />  terfere with normal traffic flow· The completed
<br />  application shall be presented to the City Coun-
<br />  cil for considerati6n and if granted by the City
<br />  Council, a license shall be issued by the City
<br />  Administrator upon payment of the required
<br />  fee.
