5.15.04 POWERS OF THE ¢
<br /> AUTHORITY.
<br /> (1) In exercising Powers Conferred by this Or
<br /> any other section of this Cede relating to com-
<br /> municable diseases, the City's Health Authority
<br /> shall be guided by the most recent instructions,
<br /> opinions and guidelines of the Center for
<br /> Disease Control ,of the United States Depart-
<br /> ment. of Health and Human· Services which
<br /> ?*-elate t° the spread of nfectious diseases.
<br /> (2) In order to ascertain the source of infec-
<br /> nd reduce its spread, the City's Health
<br /> Y, and persons under the Health
<br /> and C0ntrol,'shali ha~e full
<br /> authority to inspect or cause tolbe
<br /> and to issue orders regarding any
<br /> nmercial building, structure or premises, or
<br /> part thereof, which may be a site of high-
<br /> sk sexual conduct. If the Health A0thority
<br /> that a hazardous site exists, the
<br /> Health Authority shall ~leclare it to be a public
<br /> health hazard and public health nuisance and
<br /> Shall then: '
<br /> fa) Notify the management, oWner or tenant
<br />of the premises that the Health Auth0rify has
<br />rgasonab e be e¥ that the premises, building or
<br />;·structure is a hazardous site·
<br /> (b) Issue two writlen warnings at ieast ten
<br />days apart to the management, owner; or te

<br />building, or structore is a hazardous site.
<br />(c) once such notice and warnings bare been
<br />issued, the Health Authority, or' the Health

<br />. (1) After the management, owner or tenant of
<br />the premises has been notified in Writing aS to
<br />the basis of the Health Authority's determina-
<br />tion, the management, owner or tenant shall
<br /> ten (10)days from the date of the last
<br />warning to request a hearing before the Health
<br />Author.itt or the. Heallh Authority's appointee
<br />for.a determination as to the existence of such '
<br />hazordqus Site'. If the management, owner or
<br /> does not request a. hear- '
<br />lng w!thin ten (10) days of the·date of the'last
<br /> the Heaith Authority'shall then
