<br />TO WHOM IT MAY CONCERN:
<br /> Notice is hereby given that lhe Planning and
<br />Zoning Commission of the City of Ramsay will
<br />hold a public hearing on Tuesday, November 5,
<br />1991 at 7:30 p.m. al fha Ramsay Municipal
<br />Center, 15153 Nowthen Boulevard N,W,,
<br />Ramsay, Minnesota.
<br /> The purpose of tho hearing is to consider
<br />amendments to Chaplet 9.11.19 Subdivision 5
<br />known as the Adult uses Chapter of the Ramsay
<br />City Code (changes are indicated by bold type)
<br />as follows:
<br /> Subd. 5. Nonconforming Adult Use Principal
<br />or Accessory: Adult uses which are classified
<br />as legfll nonconforming uses may continue in
<br />accordance with the provisions of this chapter,
<br />except that any such nonconforming use shall
<br />be terminated and become illegal On and after
<br />January 31, 1992. To 1he extent possible, lhe Ci-
<br />ty shall attempt to idenlify all such uses which
<br />become classified as nonconforming under the
<br />provisions of this subdivision and shall notify
<br />the property owners and operalors of such uses,
<br />in wrillng, of the change in stalus and the terms
<br />and condilions which apply· The owner of any
<br />property on which an adult use is located may
<br />apply to the Council for an extension of the ter-
<br />mination date. Any such application shall be in
<br />writing and be received by the City no later
<br /> )ecember 31, 1991. Failure to submit a
<br /> l extension application shall constitute a
<br /> · of the right to request an extension. The
<br /> City Council may grant such an extension if
<br /> upon the Council's determination, the applicant
<br /> demonstrates that the amortization period is an
<br /> unreasonable burden upon the business and
<br /> does not allow adequate time to recover a rea'
<br /> sonable return upon the business investment.
<br /> The applicant shall have the burden of proof Io
<br /> demonstrate hardship with the established ter-
<br /> minaflon dale and also the time required for an
<br /> extension. In making its decision, lhe Council
<br /> may consider any factor relevant to the issue,
<br /> including but not limited to:
<br /> a. The degree or magnitude of threat to the
<br />public health, safety and general welfare posed
<br />by the secondary impacls et the operation.
<br /> b. The length of time that the adult Use has
<br />been operating.
<br /> c. The ease by which the property could be
<br />converted tea conforming use.
<br /> d. The nalure and character of the surroun-
<br />ding neighborhood. '
<br /> e. The value and condition of the improve.
<br />merits on the property.
<br /> f. The amount et the applicant's inveslment in
<br />the business.
<br /> g. The amount of investment already real,
<br />ized.
<br /> h. The cost of relocating the adult use.
<br /> All interested persons are invited to attend
<br />the hearing and comment on lhe proposed
<br />amendments.
<br /> Written comments are welcome and shah be
<br />addressed to the Ramsay Planning and Zoning
<br />Commission, 15153 Nowfhen Boulevard N.W.,
<br />Ramsay, Minnesota, 55303. Written commenls
<br />shall be received at the above address prior to
<br />5:00 p.m. on November 5, 1991.
