PRINTER'S AFFIDAVIT OF PUBLICATION ORDINANCE #91-18 CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AMENDMENT TO CHAPTER 7 WHICH IS KNOWN AS THE LICENSING AND PERMITS CHAPTER OF THE CITY CODE. AN ORDINANCE AMENDING CHAPTER 7, SECTIONS 7.61 ENTITLED "CHARITABLE GAMBLING" AND REPEALING SUBSEC- TION 7.62.i3 ENTITLED "USE OF BINGO PROFITS" OF THE CITY CODE OF RAMSEY, MINtJ ESOTA. The City of Ramsay ordains: SECTION 1. AUTHORITY This Ordinance is adopted pursuant to the authority granted by Minn. Stat. Chapter 349. et al. SECTION 2. AMENDMENT The following subsection is added to Sec- tion 7.61: 7.61.08 Use of Charitable Gambling Net Profits. Any licensed organization conducting lawful gambling within the City shall be required to contribute ten percent (10%) of its net profits derived from lawful gambling to a fund ad- ministered and regulated by the City withoul cost to such fund. Disbursements from this fund shall be for lawful purposes as determined from time to time by City Council resolution. The term "net profits" as used herein shall be that definition assigned to it by Minn. Stat. §349.213 (1991). This subsection shall apply to all licensed organizations conducting lawful gambling within the City, including Bingo organizations as defined and regulated by Section 7.62 herein, Subdivision 7.61.04(f) is amended fo read as follows: I.~Tl~.04(f) A lease agreement belween a licen- ~[]anization and a gambling location owner ~1~ ator shall not provide for rental payments based on a percentage of receipts or profits from lawful gambling. There shall be no other com- pensation paid to the gambling location owner or operator, directly or indirectly, other than the rental fee provided in the lease agreement. The maximum rental fee shall be as prescribed by State Statute. Subsection 7.61.07 is amended to read as follows'. 7.61.07 Fee. Upon applicalion, the City will charge all new applicants an investigation fee to cover costs incurred investigating the ap- plication. Any unused porlion ct this fee will be refunded to the applicant. This tee does not apply to applications for renewal of licenses. This fee may change from time to time as determined by resolution of the City Council. SECTION 3. REPEAL Subsection 7.62.13 entitled "Use of bingo profits" is hereby repealed. SECTION 4. EFFECTIVE DATE The effective date of this Ordinance is thirty (30) days after its passage and publication, sub- iect to Cily Charter Section 5.07.
