<br /> AN ORDINANCE AMENDING CHAPTER 7,
<br /> SECTION 7.83 ENTITLED "BURNING PER-
<br /> MITS" AND REPEALING SUB-SECTION
<br /> 7.83.01 ENTITLED "OPEN BURNING PRO-
<br /> HIBITED'', SUB-SECTION 7.83.02 ENTITLED
<br /> "RULES ADOPTED BY REFERENCE", AND
<br /> SUB-SECTION 7.83.03 ENTITLED "PERSON
<br /> DESIGNATED TO ISSUE PERMITS".
<br /> The City of R~msey ordains:
<br /> SECTION !. AMENDMENT
<br /> Section 7.83 of ~h'e City Code is amended to
<br /> read as follows: .
<br /> 7.83 OPEN BURNING
<br /> 7.83.01 PURPOSE
<br /> The purpose df this Section is to establish
<br /> permifte~l categ~'ies of oped burn events for
<br /> residences and farms within the City of Ramsay
<br /> and provide for a' permitting process for resi-
<br /> dential and agricultural open burning, except
<br /> when such open burning is defined as a "Recre-
<br /> ational Fire'~ as pr~scribed in this Section.
<br /> 7.83.02 DEr I N I TION S
<br /> For the purposes of this Section, the terms in
<br /> this Section have the meaning given them.
<br /> a) Open Burning: "Open Burning" m~ans
<br /> the burnihg of 'aNy:matter if th~ resultant com-
<br /> bustion products·are emitted directly to the at-
<br /> mosphere without passing through a stack, duct
<br /> or chimney, 'except a Recreational Fire as
<br /> defined herein.
<br /> b) Recreational'.Fire: "Recreational Fire"
<br /> means a fire set with approved starter fuel no
<br /> more than three (3) feet in height, contained
<br /> within the border of a "Recreational Fire Site"
<br /> l~j~y, (:lean wood, producing little' de/co-
<br /> oke, odor Or soot beyond the property
<br /> lih~nducted with-an adult tending the fire at
<br /> all times; for recreational, ceremonial, food
<br /> prepration or social purposes; extinguished
<br /> completely before q.uitting the occasion; and
<br /> respecting weather conditions, neighbors, 'burn-
<br /> ing bans, and air quality so that nuisance,
<br /> health or safety hazards will not be created.
<br /> Mobile cooking devices such as manufactured
<br /> hibachis, charcoal grills, Woocl smokers and"
<br /> ~ropane or natura gas devices are not defined
<br /> as recreational f.iros.
<br /> c) Recreational Fire Site: A 'fRecreationa
<br /> Fire Site" means an area of no more than a
<br /> three (3) foot diameter circle (measured from
<br /> the inside of the fire·ring or border); complete-
<br /> ly surrounded bY non-combustible and non-
<br /> smoke; or odor producing material, either of
<br /> natural rock, cement, brick, 'tile or blocks or
<br /> ferrbus metal only and which area is depressed
<br /> below ground, on the ground, or on a raised bed.-
<br /> Included are permanent outdoor wood burning
<br /> fireplace~. Burning barrels are not a Recre-
<br /> ational Fire Site as d~fined herein. Recreational
<br /> Fi~e Sites shall .not be located' closer than fifty
<br /> (50) feet to any structure.
<br /> d) Starter Fuels: "Starter Fuels" mean dry;
<br /> untreateD, unpainted kindling, branches, or
<br /> cardboard, or charcoal fire .starter. Paraffin
<br /> candles .and alcohols are permitted as starter
<br /> fuels and as aids to ignition only. Propane gas
<br /> torches or other clean ga.s burning devices
<br /> causing minimal po~luti0n·must be Used to start
<br /> an Open Burn.
<br /> e) Wood: "Wood" ,means dry, clean fuel only
<br />such as twigs, branches,- limbs, "'presto logs",
<br />charcoal, cordwood or untreated dimensional
<br />'lumber. "wood" does not include wood that is
<br />green, ,with leaves or needles, rotten, wet, dil
<br /> soaked, or. treated with paint, glue or preser-
<br /> it Clean,pallets may be 0sad for ~ecre-
<br /> I' fires when cut into three (3) foot

<br /> No person shall .conduct, cause or pe/'mit
<br /> open 'burning' of oils,, pefi'o fuels, rubber,
<br /> plastics, chemica'lly treated materials, or other .
<br /> materials which-produce excessive or noxiou~
<br /> smoke such as t res r~JJ~qgl,
<br /> painted or glued wood compos te shingles, tar
<br /> paper, insulation, composition' board, sheet-
<br /> rock, wiring, paint or paint fillers.
<br /> No person shall conduct, cause or permit
<br /> open burning of hazardous waste or salva[je
<br /> operations, or open .burning of solid waste gen-
<br /> erated from ari industrial or manufacfiJHng.
<br /> process or from .a service or commercial
<br /> establisl~ment Or building material-generated'
<br /> from demolition of. commercial or.i~stitutiohal
<br /> structures. No person shall conduct, cause or
<br /> per..mit, open burning of discarded material
<br /> resulting- from the handling,· processing;
<br /> storage,,.preparatioo, servi..n,g or.consumption of

<br /> [ No person shall start or allow any open burn-
<br /> ing. on any property .in fl~e City of
<br /> without first having obtained an Open Burn
<br /> permib except lhat a permil is not required fp'r ·
<br /> any fir~ which is a Recreat!0nof Fire as defined
<br /> herein.
<br /> .7.83..1~5 PURPOSES ALLOWED'FOR oPEN
<br /> .BURNING .
<br /> Open'Burn permits may be issued only for the
<br /> following pu~'poses: , ·
<br />a) Elimination of,fire or health hazard "~h:at
<br />· c~nnot be abated by other practical means.
<br />- 'b) G.~-eund thawing for utility repair and con-,
<br />struction.
<br />'i:). Disposal of vegetative matter for manag-
<br />· .lng forest prairie or w dfe habitat, and in the
<br />'development 'and maintenance, of land and.
<br />~ights-o~-way where ~hipping, compos, ting,
<br />landsl~reading'or other a ternat ye methods ace
<br />nut practical.
<br />d) Disposal of diseased trees genei'ated on'
<br />site~ diseased Or infected nursery stock, diseas-
<br /> ed dee hives.. - ·
<br /> e)i Disposal of unpainted, untreated, non:
<br /> glued lumber and wood shakes generated from
<br /> construction, Where recycling, reuse, removal
<br /> or'oilier alternative disposal methods are not
<br /> practical. .
<br /> Fire Training permits .can only be issued by
<br />. the Minnesota Pollution Control Agency
<br /> (MPCA). ' . ' .i . ' .
<br /> · No' f'ir~ may be all.owed to smolder with no
<br /> flame present.
<br />
<br />The permit, holder shall be responsibl~ for all
<br />costs incurred as a r~sult of the burn, im:ludi~g,
<br />but not limited to, fire suppressiqn and ad-
<br />ministrative fees.
<br /> 7.83.09 REVOCATION OF OPEN BURNING
<br />PERMIT
<br /> The Open 'Burning Permit is subiecl to
<br />revocation at the discretion of the MPCA com-
<br />missioner, or DNR: forest officer, or the City
<br />Administrator.or his/her designee. Reasons
<br />revocation 'include, but are not limited lo: ,.. e
<br />fii'e hazard existing or developing during the
<br />course of the burn, any Of the conditions of the
<br />permit being violated during the course~of Jhe
<br />burn, pollution or.nuisance conditions develop-
<br />ing during the course of the burn, or a fire
<br />smoldering with no flame present.
<br /> 7.83.10 DENIAL OF OPEN BURNING PEI~S
<br />MIT
<br /> If established criteria for the issuance of an
<br />open burning permit, are not met or during
<br />review of said appiication, it is determio~.d tha,t
<br />a practical alternative method for. disposal of
<br />the material exists, or a. pollution or nuisance
<br />condifionwould result, or if a.burn event safety
<br />plan cannot be drafted to the Satisfaction of the
<br />City Administrator or his/her desigDee, the City
<br />Administrator or his/her designee may d'e~ly
<br />the application for the open burning permit.
<br />7.83.1f BURNING BAN OR AIR QUALITY
<br />ALERT -
<br /> No Recreational Fire or Open Burn wilt be
<br />permitted when the 6ity ~r DNR has officially
<br />declared a burning ban due to potential hazard-
<br />ous fire conditions or When lhe MPCA ha~
<br />declared an Air Qua! iht Alert.
<br />7.83.12 RULES ADOPTED BY REFERENCE
<br />Minnesota Rules parts 7005.0705 to 7005.0805
<br />"Open Burning", Minnesola Statutes 88.16 to
<br />88;17 and Minnesota Uniform Fire Code (where,
<br />adopted), are hereby adopted by reference-and
<br />made a part of this Ordinance as if fully
<br />forth at this point.
<br /> SECTION 2. REPEAL
<br /> Section 7.83 of the City Code entitled "Burn-
<br />ing Permits" is hereby repe,aled. SECTION 3. PENALTY
<br /> Any person violaling any provision of this
<br />Chapter is guilty of a misdemeanor' and
<br />conviction shall be punished by a fine and/or
<br />imprisonment.
<br /> SECTION 4. EFFECTIVE DATE
<br /> The effective date of this Ordinance is thirty
<br />(~0) days after its passage and publication, sub-
