"Fair Market Value", for purposes of this <br />subdivisibn, Shall be determined at the time of approval of the final plat in accordance with <br /> <br />the follo'~ingi <br /> <br /> a. <br /> <br />The City Park and Recreation Commission and subdivider may agree <br />upon a recommendation to the City Council as to the fair market value <br />based upon recommendation by the Assessor. <br /> <br />The City Council after reviewing the Park and Recreation <br />Commission's recommendation, may agree with the subdivider as to <br />the fair market value. If agreement is not reached in this manner, then <br />fair market value shall be determined in accordance with the following: <br /> <br />The fair market value as determined by the City Council based <br />upon appraisals, accepted purchase agreements, comparable <br />market transactions or other pertinent records as determined by <br />the City Council. <br /> <br />The CitYl Council, upon review and recommendation of the Park and Recreation <br />Commission shall annually determine by resolution the park and dedication fee per <br />residential unit. <br /> <br />If, at the Option of the City Council it is determined that a cash dedication shall be made, <br />said cash Shall be placed in a special fund for Parks and Recreation use and deposited by <br />the developer with the City prior to f'mal plat approval. <br /> [, Subd. 7. Combination of land dedication and cash payment. <br />In appropl'iato plats, a combination of land and cash may be required by the City Council. <br />In the evegt a Combination of land and cash is required, the amount of land to be dedicated <br />shall be ~edited against the total park dedication requirement and the remaining cash <br />contribufi~>n Shall be based on the greater of the specified cash contribution per dwelling <br />unit or th~ fail' market value of the land. When determining the cash contribution for the <br />remaininli ae~eage, the overall density of the plat shall be the basis for determining the <br />potential ~umber of dwelling units per acre. <br /> Subd. 8. Scenic easements. In appropriate plats, as determined by <br />agreementl be[ween the City Council and the subdivider, the subdivider may dedicate to the <br />public a ~eni¢ easement in combination with the requirements of §9.50.37 Subd. 2 and 3 <br />above or, if thi~ subdivider and City Council agree, the scenic easement dedication may be <br />in lieu of tip tO 25% of the requirements in §9.50.37 Sub& 2 and 3 above. <br /> i Subd. 9. Required improvements. Subdividers shall be responsible <br />for making cer~dn- improvements to the parkland they dedicate within their development for <br />park, play,erred and public open space purposes as follows: <br /> a. Provide finish grading and tuff establishment for all park, playground, <br /> trail and public open spaces and provide landscape screening in <br /> accordance with City Policy. <br /> <br /> b. Construct and pave trails which are identified by the City as accessible <br /> bikeway/walkway trails in accordance with City Standards <br /> concurrently with the roads in their developments (i.e., grading with <br /> site grading and paving with street or parking tot paving). Grade and <br /> provide appropriate surfacing, as approved by the Park and Recreation <br /> Commission, of trails identified by the City as horse or wilderness <br /> trails.
