Subd. 2. If the amount specified in the notice is not paid within thirty (30) days <br />after mailing of the notice, it shall become a lien against the parcel where the sign was located and <br />shall be certified as an assessment against the property together with ten percent (10%) interest for <br />collection in the same manner as the real estate taxes. <br /> <br /> Subd. 3. The owner of the parcel upon which the sign is located shall be <br />presumed to be the owner of all signs thereon unless facts to the contrary are brought to the <br />attention of the Zoning Administrator. <br /> <br />may cause the <br />in this manner <br /> <br />Subd. 4. In case of emergency, the Zoning Administrator or Building Official <br />immediate removal of a dangerous or defective sign without notice. Signs removed <br />must present a hazard to the public safety as defined in the State Building Code. <br /> <br />9.12.23 Appeals <br /> <br />To provide for a reasonable interpretation of the provisions of this ordinance, a permit applicant <br />who wishes to appeal an interpretation by the Zoning Administrator may file a written appeal with <br />the City Administrator and request a hearing before the City Council. The City Council shall hear <br />the appeal, make findings and take its action. <br /> <br />9.12.2 4 Variance <br /> <br />Requests for variances from the provisions of this section shall be processed by the applicant <br />applying to the Zoning Administrator for a conditional use permit, which conditional use permit <br />procedure shall be as prescribed in Section 9.03.04 of the City Code. <br /> <br />9.12.25 Conflict <br /> <br />If any portion of this section is found to be in conflict with any other provision of any zoning, <br />building, fire, safety or health ordinance of the City Code, the provision which establishes the <br />higher standard shall prevail. <br /> <br />9.12.26 Severability <br /> <br />If any subsection, sentence, clause, or phrase of this section, or its application to any person or <br />circumstance is held invalid by the decision of any court of competent jurisdiction, the remainder of <br />this section, or the application of the provision to other persons or circumstances is in effect and <br />shall remain in full force and effect. <br /> <br />SECTION 3. <br /> <br />REPEAL <br /> <br />Section 9.12 of the City Code entitled "Signs" is hereby repealed. <br /> <br />SECTION 4. <br /> <br />pENALTY <br /> <br />Any person violating any provision of this Ordinance is guilty of a misdemeanor and upon <br />conviction shall be punished by a fine and/or imprisonment. <br /> <br />SECTION 5. <br /> <br />EFFECTIVE DATE <br /> <br />The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to <br />City Charter Section 5.07. <br /> <br />Page 17 of 18 <br /> <br /> <br />
