Subd. 2. If the amount specified in the notice is not paid within thirty (30) days after mailing of the notice, it shall become a lien against the parcel where the sign was located and shall be certified as an assessment against the property together with ten percent (10%) interest for collection in the same manner as the real estate taxes. The City Council shall hear the appeal, make findings and take its action. 9.12.2 4 Variance Requests for variances from the provisions of this section shall be processed by the applicant applying to the Zoning Administrator for a conditional use permit, which conditional use permit procedure shall be as prescribed in Section 9.03.04 of the City Code. 9.12.25 Conflict If any portion of this section is found to be in conflict with any other provision of any zoning, building, fire, safety or health ordinance of the City Code, the provision which establishes the higher standard shall prevail. 9.12.26 Severability If any subsection, sentence, clause, or phrase of this section, or its application to any person or circumstance is held invalid by the decision of any court of competent jurisdiction, the remainder of this section, or the application of the provision to other persons or circumstances is in effect and shall remain in full force and effect. SECTION 3. REPEAL Section 9.12 of the City Code entitled "Signs" is hereby repealed. SECTION 4. pENALTY Any person violating any provision of this Ordinance is guilty of a misdemeanor and upon conviction shall be punished by a fine and/or imprisonment. SECTION 5. EFFECTIVE DATE The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to City Charter Section 5.07. Page 17 of 18
