7.61.09 Use of Lawful Gambling Net Profits <br /> <br />Any organization that holds a premises permit shall be required to contribute a certain <br />percent of its net profits from lawful gambling to a fund administered and regulated by the <br />City without cost to such fund. The required percent to be contributed shall be that percent <br />established from time to time by Council resolution. However, in no event shall the <br />required percent be greater than that amount allowed by Chapter 349 of Minnesota <br />Statutes. Disbursements from this fund shall be for lawful purposes as determined from <br />time to time by Council resolution. The term "net profits" as used herein shall be defined <br />as profits less amounts expended for allowable expenses. "Allowable expenses" as used <br />herein shall not include those "lawful purpose" expenditures defined by Chapter 349 of <br />Minnesota Statutes. <br /> <br />7.61.10 Expenditures for Lawful Purposes Within City's Trade Area <br /> <br />Any organization holding a premises permit to conduct lawful gambling within the City <br />shall be required to expend 75% of its "lawful purpose" expenditures on lawful purposes <br />conducted or located within the City's trade area and to the benefit of the City's trade area. <br /> <br />In the event the City is unable to determine with a reasonable degree of certainty that the <br />required 75% of the lawful purpose expenditures of the organization holding a premises <br />permit to conduct lawful gambling within the City is being expended on lawful purposes, <br />the City Administrator may require such other financial information as is reasonably <br />necessary for the City to make this determination. <br /> <br />For purposes of this subsection, the term trade area is defined as the Cities of Ramsey, <br />Anoka, Andover, and the Town of Bums in Anoka County, the City of Elk River in <br />Sherbume County and the City of Dayton in Hennepin County. For purposes of this <br />subsection, the term "lawful purpose(s)" is that definition assigned to it by Minnesota <br />Statutes, Chapter 349. This subsection shall apply to all organizations holding a premises <br />permit to conduct lawful gambling within the City. <br /> <br />SECTION 3. VIOLATIONS <br /> <br />Anyone who violates the provisions of this section shall be guilty of a misdemeanor. This section <br />does not preclude civil and criminal penalties under applicable laws. Failure to file timely repons <br />and payments as required by this section may result in a recommendation to the Board that the <br />organization's premises permit should be revoked. <br /> <br />SECTION 4. ~ <br /> <br />The following is the official summary of Ordinance 94-05, which has been approved by the City <br />Council of the City of Ramsey as clearly informing the public of the intent and effect of the <br />Ordinance. <br /> <br />The ordinance repeals the existing City Code Section 7.61 and replaces it with a new Section 7.61. <br />This section is to regulate and control the conduct of lawful gambling pursuant to the provisions of <br />Chapter 349 of Minnesota Statutes. <br /> <br /> <br />
