what unsound trees shall be removed. The Council shall schedule an improvement hearing <br />and provide notice as prescribed in Minnesota 429.031. At such hearing or at any <br />adjournment thereof, the Council shall hear property owners with reference to the scope <br />and desirability of the proposed projects. The Council may thereupon adopt a resolution <br />confirming the original projects with such modifications as it considers desirable and shall <br />provide for the doing of the work by day labor through the City Engineer or by contract, or <br />the Council may abandon the project(s). <br /> <br />Subdivision 2. <br /> <br />With regard to any project approved, the City Engineer shall keep a record of the cost and <br />the portion of the cost properly attributable to each lot and parcel of property abutting on the <br />street or alley on which the work is done and shall report such information to the City <br />Administrator. <br /> <br />SECTION 7. <br /> <br />STREET LIGHTING SYSTEM <br /> <br />The City Administrator shall keep a record of the cost of operation of the street lighting system for <br />the 12 months preceding September 1 of each year and the portion of the cost properly attributable <br />during that period to each lot and parcel of property abutting on the street or alley in which the <br />system is located. All such costs shall be collected in the manner provided by this Ordinance. <br /> <br />SECTION 8. <br /> <br />PERSONAL LIABILITY <br /> <br />The owner of a property on which or adjacent to which a current service has been performed shall <br />be liable for the cost of such service. As soon as the service has been completed and the cost <br />determined, the City Administrator, or other designated official, shall prepare a bill and mail it to <br />the owner and thereupon the amount shall be immediately due and payable at the office of the City <br />Administrator. <br /> <br />SECTION 9. <br /> <br />ASSESSMENT <br /> <br />On or before September 1 of ~ach year, the City Administrator shall list the total unpaid charges for <br />each type of current service against each separate lot or parcel to which they are attributable under <br />this Ordinance. After notice :and hearing as provided in Minnesota Statutes Section 429.061, the <br />Council may then spread the charges against property benefited as a special assessment under <br />Minnesota Statutes, Section 429.101 and other pertinent statutes for certification to the County <br />Auditor and collection along with current taxes the following year or in annual installments, not <br />exceeding ten, as the Council may determine in each case. <br /> <br />SECTION 10. PENALTY <br /> <br />Any person who maintains a nuisance in violation of Section 2 or 3 and any person who interferes <br />with a City employee or other authorized person in the performance of any current service under <br />this Ordinance is guilty of a misdemeanor, but a prosecution shall be brought for such violation <br />only on the direction of the COuncil. If convicted of such violation, such person shall be subject to <br />a fine of not more than $700.00 or imprisonment for not more than 90 days, and the cost of <br />prosecution in either case may be added. <br /> <br />SECTION 11. SEPARABILITY <br /> <br />In case any section of this Ordinance is held invalid by a court of competent jurisdiction, the <br />invalidity shall extend only to the section affected and other sections of the Ordinance shall <br />continue in full force and effect. <br /> <br /> <br />
