Driveways and sidewalks shall have a surface <br />of either concrete or bituminus material. <br /> <br />4. Street signs of a design approved by the City shall be installed at <br /> each street intersection at the subdivider's expense. <br /> <br />e <br /> <br />No building permit shall be issued for any lot in the subdivision until <br />the improvements required by the performance contract have been <br />completed and accepted by the City, except that building permits may be <br />issued if the only improvement to be completed is that of the final <br />street surfacing and curb and gutter. Between the period of issuance <br />of the first building permit and the City's final acceptance of the <br />street, the City will snowplow the street only and will provide no <br />other street maintenance on said street. <br /> <br />170.039Q SANITARY SEWER AND WATER DISTRIBUTION IMPROVEMENTS <br /> <br />Sanitary sewers and water facilities shall be installed in accordance <br />with the standards and specifications as required by the City Council <br />and subject to the approval of the City Engineer. <br /> <br />Where City sewer and water facilities are not available for extension <br />into proposed subdivision, the Council may permit the use of individual <br />water and sewer systems in accordance with all appropriate State and <br />local regulations. <br /> <br />170.039R <br /> <br />STORM SEWERS <br /> <br />In an area not having municipal storm sewer trunk, the applicant shall be <br />responsible, before platting, to provide for a storm water disposal plan in <br />accordance with the City's Comprehensive Drainage Plan without damage to <br />properties outside the platted area and said storm water disposal plan shall be <br />submitted to the City Engineer, who shall report to the City Council on the <br />feasibility of the plan presented. No plat shall be approved before an adequate <br />storm water disposal plan is presented and approved by the City Engineer and <br />City Council. The use of dry wells for the purpose of storm water disposal is <br />prohibited. <br /> <br />In areas where an outlet for storm water does not exist and the developer is <br />unable to negotiate a drainage way with adjacent land owners, he may petition <br />the City to construct a drainage outlet. <br /> <br />170.039S <br /> <br />ELECTION BY CITY TO INSTALL IMPROVEMENTS <br /> <br />As stated in Section 170.O39F, the subdivider may elect to construct the <br />improvements at his own expense and without City participation in the expense. <br />However, the City reserves the right to elect to install all or any part of the <br />improvements required under the provisions of this title pursuant to Minnesota <br />Statutes, Chapter 429, as amended. If the City elects to install the <br />improvements, the developer shall post a cash escrow or letter of credit <br />guaranteeing payment of the assessments. <br /> <br /> <br />
