<br /> AN ORDINANCE ADDING CHAPTER 170.06
<br /> fo the ClJy Code and repealing Section 170.038F
<br /> of the CIly Code,
<br /> The City Council of the City of Ramsay hereby
<br /> ordains:
<br /> SECTION 1. ANiENDMENT.
<br /> · A Chapter 170.06 is hereby added Jo the CIly
<br /> Code, which Chapter shall be as follows:
<br /> 170.06 Park and open Space Dedication Fee
<br /> 170.061 PURPOSE
<br /> The purposes of this section ere to provide'
<br /> funds which the City shaft dedicate and use.only
<br /> for the acquisition of parks, playgrounds, and/or
<br /> open space, as well ~s provide a means for the
<br /> City to acquire a ~easonable portion of each new
<br /> subdivision fo[' public use as parks~ playgrounds
<br /> and/or open space. ,
<br /> 170.062 RESIDENTIAL BUILDING PERMIT
<br />
<br /> · PARK FEE
<br /> At the time of issuance ota building permit for
<br /> a residential dwelling unit, ellher single family,
<br /> multi-family or apartment bultdihg, the E. ullding
<br /> Official shall collecl a perk fee equal to two.and
<br /> one-half tenths of one per cent (.0025) of the
<br /> bDildlng valuation, This park fee shall he
<br /> collected from the building permll applicant as a
<br /> condition of tho issuance of the building permit,
<br /> 170.063 COMMERCIAL/INDUSTRIAL
<br /> BUILDING PERMIT PARK FEE
<br /> At the time of issuance of a building permit for
<br /> a commercial or Industrial bulldlpg, the Building
<br />~,f, flflcial shall'collect a park fee equal to one tenth
<br /> one percenl (.0010) of the building valuation.
<br /> is park fee shall be collected from the building
<br /> permit applicant as a condition of the issuance of
<br /> the building permit.

<br /> additional lend amounting to a maximum of five
<br /> percent (5%) of the gross area suDdlvlded shall
<br /> be dedicated to the rpUbllc for public.use until
<br /> written findlnss and recommendations
<br /> regarding the proposed dedications have been
<br /> made by the planning commission and presented
<br /> to the City Council. The City Council shall not
<br /> approve the dedication of an~ areas for public
<br /> use unless it dotermlnps that such areas ere
<br /> suitable and needed for the public health, sal~etyr,
<br /> convenience an¢/or.general welfare. If Ihe City
<br /> Council determlnesAhat no areas in the gross
<br /> area to be subdi¥1~ed are needed for storm water
<br /> holding areas or'ponds, then Ihe City Council
<br /> may requl're t~at'fhe area ded'lcated to the public
<br /> ' for public use as parks, playgrounds and open
<br /> space be Increased to ten percent (10%) of the
<br /> gloss area subdivided.
<br /> SECTION 2. REPEAL
<br /> ~ectlon 70.038P of the Ramsay City Code

<br /> hereby repealed,

<br />Peter G. Bodley, being duly sworn, on oath says'he is and during all the times herein stated
<br />has been the managing editor of the newspaper known as the Anoka County Union and has
<br />full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the
<br />English language in newspaper format and in column and sheet form equivalent in printed
<br />space to at least 1200 square inches (2) Said newspaper is a weekly and is distributed once
<br />each week for at least 50 weeks of each year. (3) Said newspaper, in at least half of its issues
<br />each year, has no more than 75 per cent of its printed space comprised of advertising
<br />material and paid legal notices; and in all of its issues each year, has 50 per cent of its news
<br />columns devoted to news of local interest to the community it purports to serve, and not
<br />more than 25 per cent of its total non-advertising cOlumn inches in any issue duplicates any
<br />other publication. (4) Said newspaper is circulated in and near the municipality which it
<br />purports to serve, has at least 500 copies regularly delivered to paying subscribers and has
<br />entry as second-class matter in its local post-office. (5) Said newspaper purports to serve
<br />the City of Anoka in the County of Anoka and has its known office of issue in the City of Coon
<br />Rapids in said county. (6) Said newspaper files a copy of each issue immediately with the
<br />State Historical Society. (6a) Said newspaper is made available at single or subscription
<br />prices to any person, corporation, partnership, or other unincorporated association
<br />requesting the newspaper and making the applicable payment. (7) Said newspaper has
<br />complied with all the foregoing conditions for at least one year preceding the day or dates of
<br />publication mentioned below. (8) Said newspaper has published and flied with the Secre-
<br />tary of State of Minnesota a sworn United States Post Office second class statement of
<br />ownership and circulation as of October of each year beginning in 1980.
