- 32 - <br /> <br />within 14 days following the issuance of such an order to determine whether the <br />order should be continued in force and effect. <br /> <br />The plumbing inspector may cause to be assessed against the property on which <br />an individual sewage treatment system is located the cost of proper closure, <br />restoration, and cleanup of pollution occurring as a result of a system <br />failure. Upon certification by the accountant of the cost incurred, the City <br />Administrator shall cause the cleanup assessment to be levied against the <br />property on which the system is located. <br /> <br />150 . O1 . 9B LIABILITY <br /> <br />The plumbing inspector or any employee charged with the enforcement of this <br />Chapter of the City, acting in good faith and without malice for the discharge <br />of his duties, shall not thereby render himself liable personally, and he is <br />hereby relieved from all personal liability for any d~m~ge that may accrue to <br />persons or property as a result of any act required or by reason of any act or <br />omission in the discharge of his duties. Any suit brought against the plumbing <br />inspector or employee because of such act or omission performed by him in the <br />enforcement of any provision of this chapter shall be defined by the legal <br />department of the City of Ramsey until final termination of the proceedings. <br /> <br />150.01.9C COOPERATION OF OTHER OFFICIAI~ <br /> <br />The plumbing inspector authority may request, and shall receive so far as may be <br />necessary in the discharge of his duties, the assistance and cooperation of the <br />other officials of the City of Ramsey. <br /> <br />150.01.10 APPFALS <br /> <br />Appeals from the plumbing inspector's decision and requests for variances as to <br />any provisions of this chapter may be made to the Ramsey City Council. The city <br />council may grant a variance to the strict terms or requirements of this chapter <br />as it affects specific tracts of land if it finds: <br /> <br />It is shown by reason of topography or other physical <br />conditions that strict compliance with the chapter's <br />requirements could cause an exceptional and undue hardship to <br />the enjoyment of a substantial property right; <br />By the granting of the variance, the spirit and intent of the <br />chapter will not be adversely affected; <br />That the variance will not be injurious to the health and/or <br />general welfare of: <br />(i) the users of the system for which the variance is <br /> sought, <br />(ii) the adjacent proprty owners, and <br />(iii)the general community as a whole; <br />That the establishment, maintenance or operation of the <br />system as permitted by the variance will not be detrimental <br />to or endanger the public health, safety or general welfare <br />and is not contrary to established standards, regulations or <br />ordinances of other governmental agencies. <br /> <br /> <br />
