- 32 - within 14 days following the issuance of such an order to determine whether the order should be continued in force and effect. The plumbing inspector may cause to be assessed against the property on which an individual sewage treatment system is located the cost of proper closure, restoration, and cleanup of pollution occurring as a result of a system failure. Upon certification by the accountant of the cost incurred, the City Administrator shall cause the cleanup assessment to be levied against the property on which the system is located. 150 . O1 . 9B LIABILITY The plumbing inspector or any employee charged with the enforcement of this Chapter of the City, acting in good faith and without malice for the discharge of his duties, shall not thereby render himself liable personally, and he is hereby relieved from all personal liability for any d~m~ge that may accrue to persons or property as a result of any act required or by reason of any act or omission in the discharge of his duties. Any suit brought against the plumbing inspector or employee because of such act or omission performed by him in the enforcement of any provision of this chapter shall be defined by the legal department of the City of Ramsey until final termination of the proceedings. 150.01.9C COOPERATION OF OTHER OFFICIAI~ The plumbing inspector authority may request, and shall receive so far as may be necessary in the discharge of his duties, the assistance and cooperation of the other officials of the City of Ramsey. 150.01.10 APPFALS Appeals from the plumbing inspector's decision and requests for variances as to any provisions of this chapter may be made to the Ramsey City Council. The city council may grant a variance to the strict terms or requirements of this chapter as it affects specific tracts of land if it finds: It is shown by reason of topography or other physical conditions that strict compliance with the chapter's requirements could cause an exceptional and undue hardship to the enjoyment of a substantial property right; By the granting of the variance, the spirit and intent of the chapter will not be adversely affected; That the variance will not be injurious to the health and/or general welfare of: (i) the users of the system for which the variance is sought, (ii) the adjacent proprty owners, and (iii)the general community as a whole; That the establishment, maintenance or operation of the system as permitted by the variance will not be detrimental to or endanger the public health, safety or general welfare and is not contrary to established standards, regulations or ordinances of other governmental agencies.
