- 18 - <br /> <br /> Subdivision 3. Issuance of Obliations. After a contract <br />for any of the work enumerated in Subdivision 1 has been let, or <br />the work commenced, the Council may issue obligations to defray <br />the expenses of any such work financed in whole or in part by <br />special charges and assessments imposed upon benefited property <br />under this Section. Section 210.01.13 apply to such obligations <br />with the following modifications: <br /> <br />(1) <br /> <br />Such obligations shall.be payable not more than <br />two years from the date of issuance; <br /> <br />(2) <br /> <br />The amount of such obligations issued at one time <br />shall not exceed the cost of such work during the <br />ensuing six months as estimated by the Council; <br /> <br />(3) <br /> <br />A separate improvement fund shall be set up for <br />each of the enumerated services referred to in <br />Subdivision 1 and financed under this Section. <br />Proceeds of special charges as well as special <br />assessments and taxes shall be credited to such <br />improvement 'fund. Any balance of the proceeds of <br />any obligations remaining therein may be used to <br />pay the cost, in whole or in part, or any other <br />improvement instituted pursuant to this code or <br />may be transferred to the City's public improvement <br />revolving fund. <br /> <br />210.01.15 Charter Procisionaa Effect. Local <br />improvements shall be carried out exclusively under the <br />provisions of the Charter. <br /> <br />210.01.16 Special Assessments; Governmental Un,ts. <br /> <br /> Subdivision 1. Authority to Assess. The City may levy <br />special assessments against the property of a governmental unit <br />benefited by an improvement to the same extent as if such <br />property were privately owned, but no such assessments, except <br />for storm sewers and drain systems, shall be levied against a <br />governmental unit for properties used or to be used for highway <br />rights of way. A "governmental unit" means a county, city, <br />public corporation or a school district. If the amount of any <br />such assessment) except one against property of the state, is <br />not paid when due, it may be recovered in a civil action brought <br />by the City against the governmental unit owning the property so <br />assessed. <br /> <br /> Subdivision 2. Determination. In the case of property <br />owned by the state or any instrumentality thereof, the Council <br />may determine the amount that would have been assessed had the <br />land been privately owned. Such determination shall be made <br />only after the Council has held a hearing on the proposed <br />assessment after at least two weeks' notice of the hearing has <br /> <br /> <br />
