170.0130 ZONING AMENDMENTS <br /> <br />Zoning amendments may be initiated by a petition from a member of City Council, <br />Planning Commission or property owner; are subject to a public hearing; and all <br />costs incurred in the processing of it are the responsibility of the applicant. <br />Council shall take action within 45 days of the public hearing and passage <br />requires a 4/5 vote of Council. <br /> <br />170.013D CONDITIONAL USE PERMITS <br /> <br />A conditional use permit provides the City the discretion to allow a non- <br />permitted use in any particular zone. Applications are filed with the Zoning <br />Officer; referred to Planning Commission for public hearing and recommendation <br />to City Council within 30 days of hearing; referred to Council for review, <br />adoption of findings of fact and action within 30 days after receipt of <br />recommendation from Planning Commission. All costs incurred in processing the <br />application are the responsibility of the applicant. <br /> <br />170.013E REVOQATION OF CONDITIONAL USE PERMITS <br /> <br />Permit shall become null and void if use does not commence within 1 year of <br />permit issuance or if use is discontinued for a continuous 12 month period. <br />Council has the authority to revoke the permit, after conducting a public <br />hearing, if conditions of the permit are violated. <br /> <br />170.013F DURATIQN OF QONDITIONAL USE PERMITS <br /> <br />Permit remains in effect as long as conditions of it are observed; one of the <br />conditions may be a time limitation. <br /> <br />130.013G VARIANCES <br /> <br />Variances allow the city to offer relief from unnecessary hardships resulting <br />from rigid enforcement of the Zoning Ordinance. Variances are filed with the <br />Board of Adjustment, pertain only to physical characteristics of the land or <br />structures to be built thereon, and are subject to a public hearing. The <br />decision by the Board of Adjustment is the City's final action and all costs <br />incurred in processing the application are the responsibility of the applicant. <br /> <br />170.013H BOARD OF .ADflUSTMENT <br /> <br />The Board of Adjustment consists of the 7 Planning and Zoning Commission <br />members and shall have the power to hear and decide appeals from any decisions <br />made by the Zoning Officer in administering this Zoning Ordinance. <br /> <br />170.013I EN~0R~EMENT/PENALTIES <br /> <br />Each day a violation of this Zoning Ordinance exists shall constitute a <br />separate offense and is subject to Council action through legal channels. <br /> <br />170.014 ZONING DISTRICTS <br /> <br />170.014A DISTRIGTAND.DEVELOPMENT AREA BOUNDARIES <br /> <br />District and development area boundaries shown within the lines of roads, <br />streams, and transportation rights-of-way shall follow the centerlines and <br /> <br /> <br />
