<br />b. Said policy shall be for the full period of the
<br />pea-mit and shall provide for the giving of ten
<br />(101 days prior notice to the City Clerk by regis·
<br />tered mail of terr~lnation, cancellation, or
<br /> amendment of the policy, .
<br /> c. In the event said policy is terminated for
<br /> any reason~ the permit shall be automatically
<br /> su-spended upon the day the policy terminates,
<br /> unless a new policy complying with this section
<br /> is obtained and filed with the Clerk prior to the
<br /> termination of the policy in force.
<br /> '!T0.Ot7M(81 Regulations and Requirements
<br /> and Operating Standards:-
<br /> a. The Council as a pre-requisite to the gran-
<br /> ting of said permit or after such permit has
<br /> been granted, may impose such further restric-
<br /> tions and requirements as may be reasonable
<br /> and necessary under the particular cir-
<br /> cumstances Of each application. Such restric-
<br /> ti0ns and requirements may be in contract form
<br /> with the applicant or any other person interest-
<br /> ed dlrectly or indirectly In the issuance of such
<br /> permit.
<br /> b. No excavation or digging shell be made
<br /> beyond the Iimits for which the parficula~ per-
<br /> mit is granted and in no case shall any excaVa-
<br /> tion or digging be made within thirty (30) feet
<br /> of any adioining road right-of-way or structure
<br /> as may be in the area without obtaining spec[ftc
<br /> approval by the Council,
<br /> c. Where excavations are made within thirty
<br /> (30) feet of a public roadway or other right-of-
<br /> waY, the permittee shall erect either a suitable
<br /> guardrail along said right-of-waY or roadway or
<br /> conslrucf a dirt berm not less than thirty (30)
<br /> inches in height and six [67 feet in widlh at the
<br /> base.
<br /> d. All reasonable means shall be employed by
<br /> applicant to reduce dust, noise and nuisances.
<br /> e. Noise - the maximum noise level at the pa'
<br /> rimeter of the site shall be within the limits set
<br /> by the Minnesota Pollution Control Agency and
<br /> the Environmental Protection Agency of the
<br /> United States.
<br /> f. Hours - all mining operations shall be con-
<br /> ducted between 6:30 a.m. and 8:00 p.m. on
<br /> weekdays only unless otherwise specifically ap-
<br /> p¥oved by the City Engineer or his agent.
<br /> g. Explosives ' the use and handling of ex-
<br /> plosives shall be coordinated with the City
<br /> pollce department. BlaSting shall occur only at
<br /> · hours specified by the police department and at * ..................
<br /> no other time·
<br /> h. Dust - operators shall utilize all practical
<br /> means to reduce the amount o1 dust caused by
<br /> the operation. In no case shall the amount of
<br /> dust or other particulate matter exceed the
<br /> standards established by 1he Minnesota Poilu.

<br /> d. The finished grade shall be such that It
<br />not adversely affect the surrounding land or
<br />future development of the site and shall be con-
<br />slstent with the end use plan.
<br /> e. Within thirty (30) days afler tl~e deposit of
<br />' approved fill materials, the filled area shall be
<br /> covered with a minimum of six (6) inches clean
<br /> flit, and 1he depth of the fill shall be controlled
<br /> to blend with the surrounding ground condi-
<br /> tions.
<br /> 17B.017M(12} Existing Operations:
<br /> Existing grading, mining and filUng opera-
<br /> tions shall comply with these provisions within
<br /> 180 days following the effective date of this or-
<br /> dinance.
<br /> SECTION 2. PENALTY
<br /> Any person violating any provision of this or-
<br />dinance is guilty of a misdemeanor and upon
<br />' conviction shall be punished by a fine of not
<br /> more than $750.00 or imprisonment for not more
<br /> than ninety (90) days or both.
<br /> SECTION 3. EFFECTIVE DATE
<br /> This ordinance becomes effective upon its
<br /> passage and thirty (30) days after its publica.
<br /> tlon according to law, subject to City Charter
<br /> Provision, Section 5.04.
