<br /> EQUIVALENT OF MIXED MUNICI PAL SOLID
<br /> WASTE ACCEPTED'AND DISPOSED OF IN
<br /> THE CITY OF RASMEY.
<br /> The City of Ramsey Ordains:
<br /> 5SECTION 1 AMENDMENT
<br /> Chapter 130.10 of the City Code is hereby
<br /> amended to read as follows:
<br /> 130.10 AUTHORITY AND PURPOSE.
<br /> 1. AUTHORITY. This ordinance is adopted
<br /> , pursuant to the authorization contained in MSA
<br /> 11~iA~921. ; .
<br /> 2. puRpOSE. It-is the purpose of this
<br /> ordinance to impose a fee of 25 cents per cubic
<br /> yard of Waste or its equivalent deposited in
<br /> mixed municipal solid waste facilities located in
<br /> the City of. Ramsay.
<br /> : 1~8:18.2 GENERAL PROVISIONS.
<br /> 1[ DEFINITION. For purposes of this chapter
<br /> the term "mixed municipal solid waste" means
<br /> garbage, refuse, and other solid waste from
<br /> .residential,: commercial, industrial, and
<br /> community activities which Js generated and
<br /> collected Jn aggregate, but does not include auto
<br /> hUlks, street sweepings, ash, construction
<br /> debris, mining waste, sludges, tree and
<br /> agricultural, wastes, tires, lead acid.batteries,
<br /> and othe'r materials collected, processed, and
<br /> disposed of as separate Waste streams.-
<br /> DIsPosAL
<br />iPEE ON OPERATORS OF
<br /> ILITIE$. Thereis hereby imposed a fee on
<br /> at0rs Of facilities which accept and dispose
<br /> · '"6T-.mixed municipal solid waste in the City of
<br /> Ramsay. . -
<br /> '3. AMOUNTOP FEE. The fee shall be 25 cents
<br />; per cubic yard 0~ its equivalent of all solid waste
<br /> a~¢epted and disposed of at any facility for
<br /> mixed municipal solid waste located imthe City
<br /> of Ramsey. .
<br /> 4: PARTIAL EXEMPt'ION FROM FEE
<br /> Waste· residue from energy end resource
<br /> recovery, facilities at which solid waste is
<br /> processed for the purPoSes ?f extracting,
<br /> reducing, converting-'to' energw.:or.:otherwise
<br />
<br /> .Shall be exempt fr0m one,half the amount of the
<br /> 'feb imposed if'there is at least an eighty-five
<br /> ' percent. '(85%) volume reduction in the solid
<br /> waste processed. TO qualify for exelmption under
<br /> this clause, waste residue mUst be brought tO the
<br /> facility separately. Before any fee is reduced,
<br /> the".rVerification procedures of MsA.473.843,
<br /> Subdivision 1, Paragraph (c), must be followed
<br /> and submitted to theCity.
<br /> - '5;tRETURNS, . FEE PAYMENT AND
<br /> REPORTING REQUIREMENTs. '
<br /> ~;~ Time for Payment of .Fee to City· The fee
<br /> imposed bythis.chapter shall be due and payable
<br /> bW the -operator of the. facility: to the City of
<br /> Ramsey monthly on or before the twentieth day
<br /> of;the mon'~h immediately following the month in
<br /> which ~the ,solid waste .was received at. the
<br /> facility.
<br /> b. Returns. Any operator subject to the fee
<br /> imposed by .this subsection shall file a return
<br /> prescribed by the City. The: return must be
<br /> ~sigtled by the oPerator Or person authorized by
<br /> fhb bperator to do so. The return shall be filed
<br /> - with the City on or before the twentieth day of the
<br /> month immediately following the month in which
<br /> solid waste was received at the facility .and
<br /> be accompanied by payment of the>fee
<br /> that month;
<br /> Extensions. ~The 'City may extend for
<br /> reasonable cause the time fo[ filing returns and
<br /> , remittance of fees for not more than sixty (60)
<br /> days· ~he Citymay require a tentative return at
<br /> the time fixed for filing the regularly required
<br /> return and payment of the fee-therewith on the
<br /> basis of such estimated return·
<br /> d. Reporting Requirements· The monthly
<br /> return required to be filed shall show: (a)
<br /> amount of cubic yards of sOlid waste accepted
<br /> and disposed of at the facility; and (b) amount of
<br /> due on the return computed by multiplying
<br /> ,ards of solid waste acEepted and
<br /> of at the facility times fifteen cents
<br /> (15); and (c) such other information as may be
<br /> required by the City in order to administer this
<br /> subsection.
