170.0711.3 <br /> <br />170.0711.31 <br /> <br />170.0711.32 <br /> <br />170.0711.4 <br /> <br />170.0711.41 <br /> <br />170.0711.42 <br /> <br />170.0711.43 <br /> <br />170.0711.5 <br /> <br />170.0711.51 <br /> <br />Variances <br /> <br />The grant of a variance requires the presence of the <br />following conditions: <br /> <br />(1) The strict enforcement of the land use controls will <br /> result in unnecessary hardship. <br /> <br />(2) Granting of the variance is not contrary to the pur- <br /> pose and intent of the zoning provisions herein <br /> established by these standards and criteria, and is <br /> consistent with the Management Plan for the Rum River. <br /> <br />(3) There are exceptional circumstances unique to the <br /> subject property which were not created by the land- <br /> owner. <br /> <br />(4) Granting of the variance will not allow any use which <br /> is neither a permitted or conditional use in the land <br /> use district in which the subject property is located. <br /> <br />(5) Granting of the variance will not alter the essential <br /> character of the locality as established by the Manage- <br /> ment Plan for the Rum River. <br /> <br />Ail variances to the requirements of this ordinance must <br />be certified in accordance with Section 170.0711.7 of this <br />ordinance. <br /> <br />Plats <br /> <br />Copies of all plats within the boundaries of the Scenic <br />River Land Use District shall be forwarded to the commissioner, <br />within ten (10) days of final approval by Ramsey. <br /> <br />Inconsistent Plats: Approval of a plat which is inconsistent <br />with this ordinance is permissible only if the detrimental <br />impact of the inconsistency is more than overcome by other <br />protective characteristics of the proposal. <br /> <br />Ail inconsistent plats approved by the Ramsey City Council <br />must be certified in accordance with Section 170.0711.7 of <br />this ordinance. <br /> <br />Amendments <br /> <br />This ordinance may be amended whenever the public necessity <br />and the general welfare require such amendments by the pro- <br />cedure specified in this section. Amendments to this ordi- <br />nance must be certified by the Commissioner as specified in <br />Section 170.0711.7 of this ordinance. <br /> <br />-15- <br /> <br /> <br />
