170.0711.8 170.0711.81 170.0711.82 170.0711.83 170.0712 (a) The hearing will be held in an appropriate local community within sixty (60) days of the demand and after at least two (2) weeks published notice. (b) The hearing will be conducted in accordance with Minnesota Statutes 105.44, Subdivision 5 and 6 (1971) as amended. (c) The Commissioner shall either certify his approval or disapproval of the proposed action within thirty (30) days of the hearing. (5) The following recreational uses shall require certifi- cation approval by the Commissioner: (a) Governmental campgrounds (b) Private campgrounds (c) Public accesses, road access type with boat launching fac ilit ies (d) Public accesses, trail access type (e) Temporary docks (f) Other governmental open space recreational uses Enforcement It is declared unlawful for any person to violate any of the terms and provisions of this ordinance. Violation thereof shall be a misdemeanor. Each day that a violation is permitted to exist shall constitute a separate offense. In the event of a violation or a threatened violation of this ordinance, Ramsey or the Commissioner of Natural Resources, in addition to other remedies, may institute appropriate actions or proceedings to prevent, restrain, or abate such violations or threatened violations. Any taxpayer or taxpayers of Ramsey may institute mandamas proceedings in the District Court to compel specific performance by the proper official or officials of any duty required by this ordinance. EFFECTUATION This ordinance shall be in full force and effect from and after its passage, approval, and publication as provided by law. -18-
