1. No license shall be granted, or renewed, for operation on any premises on <br />which taxes, assessments or other financial claims of the city are delinquent and un- <br />paid. In the event an action has been commenced pursuant to the provisions of Chapter <br />278, Minnesota Statutes, questioning the amount or validity of taxes, the council may, <br />on application by the licensee, waive strict compliance with this provision; no waiver <br />may be granted, however, for taxes or any portion thereof which remain unpaid for a <br />period exceeding one (1) years after becoming due. <br /> <br />2. No license shall be granted to a foreign corporation. <br /> <br /> 3. No license shall be issued for the premises owned by a person to whom a license <br />may not be granted under this section, except that a license may be issued if the owner <br />of the premises is a minor, alien, or a person who has been convicted of a crime other <br />than a violation of Minnesota Statutes, Section 340.07 through 340.39. <br /> <br /> 4. No license shall be granted for any place which has a common entrance or exist <br />between any two (2) establishments, except that a public concourse or public lobby <br />shall not be construed as a common entrance or exit. <br /> <br /> 5. No "off-sale" license shall be granted unless the building proposed to be the <br />licensed premises contains the following space requirements: <br /> <br />a. A minimum of 3,000 square feet on the ground level floor, and <br /> <br />b. A full 3,000 square foot basement usable for storage purposes. The <br />space required by both (a) and (b) herein must be devoted exclusively <br />to the use of "off-sale" liquor sales. <br /> <br /> 6. No "off-sale" license shall be granted within 1,000 feet of any elementary, <br />secondary or vocational school or within 1,000 feet of any chrch. For purposes of <br />this measurement the distance shall be determined by measuring the distance between <br />the main entrance of the school and church and the main entrance of the licensed <br />business. <br /> <br /> 7. No "off-sale" license of any kind shall be granted maless the premises to be <br />licensed are located in a general commercial area. <br /> <br /> 8. No "off-sale" license shall be granted where the building proposed to be the <br />licensed premises is within 1200 feet of any building which houses an existing "on-sale" <br />premises. For purposes of this measurement the distance shall be determined by measur- <br />ing the distance between the main entrance of the existing "on-sale" premises and the <br />main entrance of the licensed business. <br /> <br />130.0911 - Conditions Governing Issuance. The following conditions govern issuance of <br />a license pursuant to this section: <br /> <br /> 1. Every license shall be granted subject to the provisions of this section and <br />of any other applicable ordinance or law, including Chapter 340 of Minnesota Statutes. <br /> <br /> 2. The license shall be posted in a conspicuous place in the licensed premises <br />at all times. <br /> <br /> 3. Every licensee shall be responsible for the conduct of his place of business <br />and for the conditions of sobriety and order in the place of buisness and on the premises. <br /> <br />4.
