A. Commercial Kennels shall remain under the

<br /> kennels were:
<br /> a. Mere than two (2) animals are kept on a land·

<br /> .SECTION 1. the premisas. -
<br /> a. Section 2 of Ordinance 73-5 is hereby amended to
<br />
<br /> read as follows: '
<br /> As used in the ordinance unless the Context
<br /> otherwise indi~:ates:
<br /> A. "Animal" shall be intended to mean a cat or
<br /> dog. .
<br /> B. "Dog" shall be intended to mean both male and
<br /> female.
<br /> C. "Owner" shall be intended to mean any person
<br /> or persons, firm, association or corporation owning
<br /> keeping or harboring a dog.
<br /> D. "At Large" shall be intended to mean off the
<br /> premises of the owner and not under the custody and
<br /> control of the owner or other per~en either by leash,
<br /> cord, chain or otherwise.
<br /> E. "Commercial kennel" isanyplacewheredogs
<br /> or other animals are kept where the business of
<br /> raising, selling, boarding, breeding,showir~g,
<br /> treating or grooming of dogs or other.animals is
<br /> conducted.
<br /> F. "Private kennel" is any premises where dogs
<br /> or cats are kept or harbored under circumstances
<br />i~%amounting operation of a
<br /> to
<br /> the
<br /> commercial
<br />~el but require 'a conditional use permit as
<br />~l~[hdedqn Section 20 herein. .
<br /> G. "Release Permit" shall be intended'to mean a
<br /> temporary release for a period of not more than 72
<br /> hours with purchase fees to .be applied to regular
<br /> license purchase, provided this is done within the 7.2
<br /> hours. A release permit may be obtained at the City's
<br /> discretion upon payment of a fee in accordance to
<br /> that regular license requirement and payment of a
<br /> release fee ($10.00) and any maintenance costs
<br /> applied.
<br /> b. Section ~ of Ordinance 73-6 is hereby amended
<br /> to read as follows:
<br /> All dogs, kept, harbored or maintained by their
<br /> dwners in the City of Ramsay shall be licensed and
<br /> registered if over 6 months of age. DOg licenses shall
<br /> be issued by the City Clerk upon payment of a license
<br /> fee for $3.00 for each male or Spayed fa.male, and
<br /> $5.00 for each unspayed female· License fees shall
<br /> not be prorated. The owner shall state at the time
<br /> application Is made for such license and upon forms
<br /> provided for such purpose his name and address, and
<br /> the name, breed, color and sex of each dog owned or
<br /> kept by him.
<br /> Every application for a license for a spayed female
<br />dog shall be accompanied with.a statement from a
<br />licensed veterinarian indicating that the dog has
<br />been spayed and giving the date of the operation.
<br />Licenses shall 'not be required for dogs less than six
<br />· (6) months of age.
<br /> c. Section 8 of Ordinance73.6 is hereby amended to
<br /> read es follows:
<br /> The proper officer appointed to enforce this or-
<br /> dinance shall impound any dog found unlicensed dP
<br /> running at large a~d shall give notice of the Il.
<br /> pounding to the owner of such dog If known. In case
<br /> theowner is unknown, such officer shall post notice
<br />
<br /> 3. Statement as to whether the animals will be
<br /> kept primarily within the home or building of
<br /> residence or outside in a separate structure.
<br /> 4. Location and distance (in feet) of all existing'or
<br /> proposed kennel structures in relation to abuttihg
<br /> prbperty.
<br /> 5. A listing of.the type of fencing and construction
<br /> of kennel (if applicable).
<br /> 6. A statement regarding the proposed method to
<br /> be used to keep the premises in a sanitary condition.
<br /> 7. A list of the names and addresses of all nelgh-
<br /> bors within 350 feet of the proposed kennels.
<br /> 8. An agreement by the applicant that the
<br /> premises may be inspected by the Ramsey Zoning
<br /> Officer at any reasonable time.
<br /> The Ramsey City C~uncil shall have the discretion
<br /> Whether to issue such a permit or not. In making
<br /> such determination,, the Council shall take into
<br /> consideration th~ adequacy of housing and runs for
<br /> the animals, the methods used for sanitation and to
<br /> maintain quiet~ facilities for containing the animals
<br /> and whether or not there have been numerous
<br /> previous Violations of this Ordinance by the owner.
<br /> If a permit is granted and the applicant thereafter
<br /> fails to comply with the statements made in the
<br /> application or Continuously violates Other provisions
<br /> of this ordinance, the permit holder shall be notified
<br />' b~ the Zoning Officer and given ten days to remedy
<br /> any defaults or defects. If such cor~itions are not
<br />~ re'medied within the ten days, a h(~aring ~shall be held
<br /> by the City Council to determine whether the permit
<br /> shall be revoked. Such hearing shall be held after at
<br /> least ten days mailed notice to Jhe permit holder. If it
<br /> shall appear that siad kennel is not being properly
<br /> maintained, the Council may revoke the kennel
<br /> permit and the owner must immediately adlust the
<br /> number of animals kept on the premises to that
<br /> stated previously in this section. SECTION 2. PENALTY
<br /> Any person, firm or corporation violating any
<br /> provisions of this ordinance is guilty of a
<br /> misdemeanor and upon conviction thereof shall be
<br /> punlshed by a fine of not more than $300.00 or im-
<br /> prisonment in the city or county jail for not more
<br /> than 90 days or both. Each day such a violation is
<br /> committed or permitted to continue shall constitute a
<br /> separate offense and shall be punishable' as such
<br /> hereunder.
<br /> SECTION 3. EFFECTIVE DATE
<br /> This ordinance shall be in full force and effect from
<br /> and after its passage and publication.
