by the City Council and-or its designated <br /> representalivo. <br /> V, Penalties <br /> Any violation of this Section is a misdemeanor and <br /> is subject to all penalties for such violations under <br /> the provisions of Section 12 of this ordinance. <br /> SECTION 14. CONTRACTORS <br /> a. Construction <br /> That it is deemed in the interest of the public and <br /> the residents of the City of Ramsay that the work <br /> involved in building alterallon and construction and <br /> the installation Of various appliances and service <br /> facilities in and for said buildings be done only by <br /> individuals, firms and corporations that have <br /> demonstrated or submitted evidence of their com. <br /> petency to perform such work in accordance with the <br /> applicable ordinances of the City of Ramsay <br /> regulating same. <br /> b. Contractor's Licensed <br /> The permits which the Zoning Officer is authorized <br /> to issue under the ordinances of the City of Ramsay <br /> shall be issued only to individuals, firms or cor- <br /> poralions holding a license issued by the City for <br /> work to be performed under the permit, except as <br /> hereinatter noted. <br /> c. Requirements <br /> Application for license shall be made to the Zoning <br /> Officer and such license shall be granted upon proof <br /> of the applicant's qualifications therefore, their <br /> willingness to comply with the provisions of the or. <br /> dinances, the filing of certificates evidencing the <br /> holding of Public Liability insurance in the limits of <br /> $100,000.00 per person and $300,000.00 per accident <br /> for bodily injury and $100,000.00 for property <br /> damages and cerlificates of Workmen's Com- <br /> pensation insurance as required by law, and upon <br /> filing a surety bond in lhe amognt of $2,000.00 con- <br /> ditioned upon compliance with the provisions of the <br /> City's ordinances and state statutes. Any person <br /> aggrieved by the Zoning Officer's refusal fo issue a <br /> ticense may appeal the zoning officer's decision to <br /> theCity Council, which shall then review the Zoning <br /> Officer's decision and either affirm or reverse said <br /> decision. <br /> d. Fee <br /> The annual license fee and expiration date shall be <br /> as provided in Section 10 of this ordinance, except <br /> that no license shall be required for (1) plumbing <br /> work that entails lhe installation within ~'~ilding of <br /> the pipes, fittings, and flxfures that carry water and <br /> waste; (2) electrical construction and Installation; <br /> (3) water conditioning serviclng and installation and <br /> (4) water supply installation and construction (well <br /> drillers) provided that the applicant for any of these <br /> licenses presents for filing a copy of his license <br /> issued by the appropriate State of Minnesota <br /> Regulatory Board. <br /> e. Specific Trades Licensed <br /> Licenses shall be obtained by every person <br /> engaging in lhe following businesses or work in <br /> accordance with the applicable ordinances of the <br /> City of Ramsay: <br /> 1. General contractors in the business of building <br /> construction <br /> 2. Heating, ventilation and rofrlgeratlon <br /> 3. Water supply system installation and con- <br /> struction <br /> ,h Sewer and water connections belween street <br /> connection and property line. <br /> 5. Plumbing, including the installation of cesspool, <br /> septic tank, drainfields, connections fo the municipal <br /> system, inside plumbing and the business of <br /> scavenging. Water supply system Installation and <br /> conslruc lion. <br /> 6. Excavations, including excavation for footings, <br /> basements, sewer and water line installation. 7. Cement contractors and block layers. <br /> Nothing here shall be construed as preventing any <br /> such qualified licensee from performing the work by <br /> anemployee under his supervision and control, or by <br /> contract with another person qualified to perform <br /> the same, provided the contractor is subject to the <br /> control of the licensee and the licensee is at all times <br /> responsible for the work performed. f. Permit to Owners <br /> The owner of any property may perform work on <br />prOperty which he occupies so long as the work when <br />performed is in accordance with the ordinances of <br />the City and for such purpose a permit may be <br />granted to such owner without a license obtained. g. State Licensed Contractors Excepted <br /> Those persons who possess valid master licenses' <br />issued by the State of Minnesota shall not be required <br />to obtain a license from the City; they shall, <br />however, be required to file proof of the existence of <br />a valid master's license together wilh proof of <br />satisfactory Workmen's Compensation Insurance <br /> <br /> coverage. <br /> h. Public Service Corporations Excepted <br /> Public Service Corporations shah not be required <br /> toobtain licenses for work upon or in connection with <br /> their own property except as may be provided by <br /> othor ordinances. <br /> i. Manufacturers Excepted <br /> Manufacturers shall not be required to obtain <br /> licenses for work incorporated within equipment as a <br /> paid'of manufacturing except as may be provided by <br /> other sections of this ordinance. <br /> i. Assumption of Liability <br /> This section shall not be construed fo affect the <br /> responsibility of any party owning, operating, <br /> controlling or i,~.~talling the a hove descr bed work for <br /> damages to. persons, or property caused by any defect <br /> therein or shall the City of Ramsay be held as <br /> assuming any such liability by reason of the licen- <br /> sing of per.sons, firms or corporations engaged in <br /> such work. <br /> k. Penalties <br /> · Any violation of this Section is a misdemeanor and <br /> ~s subject to all penalties for such violations under <br /> the provisions of Section 1') of this ordinance. <br /> SECTION 15. BOWLING ALLEYS <br /> a. License Required <br /> NO person shall own, operate, or maintain any <br /> Bowling Alley in the City of Ramsay without ob- <br /> taining a license therefor pursuant fo the provisions <br /> of this ordinance. <br /> b. Application <br /> Application shall be made wilh the City Clerk on <br /> forms furnished by the City. The applicant shall <br /> provide such information as the City Council shall <br /> require. <br /> c. Fees <br /> <br /> Theannual license fee and expiration date shall be <br /> as provided in Section 10 of this ordinance. d. Penalties <br /> Any violation of this Section is a misdemeanor and <br /> is subiecf to all penalties for such violations under <br /> the provisions of Section 12 of this ordinance. <br /> SECTION 16. BILLIARDS <br /> a. License Required <br /> Noperson shall own or maintain any Billiard Table <br /> in the City of Ramsay without obtaining a license <br /> therefor pursuant to the provisions of this ordinance. b. Application <br /> Application shall be made with the City Clerk on <br /> forms furnished by the City. The applicant shall <br /> provide such information as /he City Council shall <br /> require. <br /> c. Peas <br /> <br /> Theannual license fee and expiration date shall be <br /> as provided in Section 10 of this ordinance. d. Exemptions <br /> Any person owning or maintaining a Billiard Table <br /> in a private home or apartment building shall be <br /> exempt from the requirements of this ordinance. e. Penalties <br /> Any violation of this Section is a misdemeanor and <br /> is subject to all penalties for such violations under <br /> the provisions of Section 12 Of this ordinance. <br /> SECTION 17. CIGARETTE SALES <br /> a. License Required <br /> No person shall sell, give away, barter, or expose <br /> for sale any cigareHe, cigarette paper or wrappers <br /> at any place within Ramsay, without having first <br /> obtained a license therefor as provided in this or- <br /> dinance. <br /> b. Application <br /> Any person desiring to obtain such a license shall <br /> apply in writing to the City Clerk stating his name, <br /> residence, citizenship, the IocaHon of premises to be <br /> used for such sale, the nature and-name of fha <br /> business and pay at the time of making his ap- <br /> plication the required license fee. The Clerk shall <br /> present such application to the Council at their next <br /> meeting for action. And, upon the granting of the <br /> license the Clerk shall issue to said applicant a <br /> license which shall be kept posted in a conspicuous <br /> place on applicant's premises. c. Fee <br /> <br /> The annual license fee and expiration date shall be <br />as provided in Section 10 of this ordinance. d. Penalties <br /> Any violation of this Section is a misdemeanor and <br />is subject to all penalties for such violations under <br />the provisions of Section 12. of this ordinance. <br />SECTION 18. MUSIC FESTIVALS a. Definitions <br /> For the purpose of this Section Music Festivals <br />shall mean and include any gathering of individuals <br />for th~ purpose of participating in or attending a <br />musical carnivab "rock" festival or like musical <br />activity at which vocal or instrumental or both vocal <br />and instrumental music is provided by professional <br />or amateur Performers, or by I~re-recorded means, <br /> <br /> and to which gatherings members of the public are <br /> invited or admitted with or without the payment of <br /> admission charges in any form. b. License Required <br /> If shall be unlawful for any person, group of per. <br /> sons or entity to operate, conduct, maintain, ad- <br /> vedise, sell or furnish tickets or other types of <br /> written authority fo admission to a music festival in <br /> the City of Ramsay unless a license fo operate or <br /> conduct such festival shall have been issued Jn the <br /> manner hereinafter described in this chapter. c. Fees <br /> The permit fee and expiration date shall be as <br /> provided in Section 10 (~f this ordinance. d. Application <br /> Application for a Hcense to conduct a music <br /> festival shall be made in writing to the City Clerk at <br /> least sixty (60) days prior to the time indicated for <br /> the cornmencemenf of the music festival. The ap- <br /> plication shall be accompanied by a non-refundable <br /> application fee ill the amount of Fifty Dollars <br /> (~S0.00), which filing fee shall be paid to the City of <br /> Ramsay, and which said application shall contain the <br /> following information: <br /> 1. The name (including 8lies) age, residence <br /> mailing address, and telephone numbers of each <br /> person making the application. If the application is <br /> filed by a partnership, the name, (including alias), <br /> age, residence and mailing address and telephone <br /> numbers of each partner shall be included. If the <br /> applicant is a corporation or a common law or <br /> Massachusetts Trust, the application shall be signed <br /> by the President and Secretary thereof, or in the case <br /> of a common law or Massachusetts Trust, then by the <br /> Trustees thereof and in each instance shall contain <br /> their residences, mailing addresses and telephone <br /> numbers, the telephone numbers, the mailing ad- <br /> dresses and the street addresses of the Principal <br /> place of business of the corporation or trust and in <br /> thecaseof a corporation shall a lsd include a certified <br /> copy of articles of incorporation and the by-laws of <br /> thecorporation, and in the case of a common law or <br /> Massachusetts Trust shall include a certified copy of <br /> the trust indenture. <br /> 2. The location and legal description of the <br /> premises where the music festival is proposed to be <br /> conducted, including all lands to be used for <br /> automobile parking and other incidental uses. The <br /> applicant shall submit proof of ownership of said <br /> premises and the written consent of all owners <br /> thereof for the proposed use. <br /> 3. The date or dates and the hours during which <br /> the festival is to be conducted. <br /> 4. An estimate of the numbers of persons and <br /> spectators expected to attend the proposed music <br /> festival on each day it is conducted, together with <br /> detailed information supporting such estimate. <br /> 5. A detailed statement of the applicant's program <br /> and plans to provide emergency communications, <br /> security protection, water supply, food supply, <br /> sanitary fa_cilities, medical facilities and services, <br /> vehicle parking space, vehicle uses and on-site <br /> traffic control, sound and lighting equipment, fire <br /> protection, garbage, trash-and litter clean-up ser- <br /> vice, and if it is proposed or expected that spectators <br /> or participants will remain at night or overnight, the <br /> arrangements for illuminating the premises and for <br /> camping and similar facilities. There shall be in- <br /> cluded a map showing the location of all such <br /> facilities and equipment on the premises including <br /> the location of all loud speakers and the location of <br /> all toilets, medical facilities and solid waste <br /> receptac les. <br /> <br /> 6. A detailed explanation of the applicant's plan <br /> for policing the activity with particular emphasis on <br /> the control and prevention of alcoholic and drug <br /> consumption. <br /> e. Agreement <br /> The Application shall include an agreement filed <br />by the applicants and by the owners of the subject <br />premises that they will reimburse all owners and <br />occupants of property adjoining the subiect premises <br />for any and all loss, injury or damages to such <br />owners or occupants or to their property caused by <br />theapplicants, by the owner of the subject premises, <br />or by any person attending or participating in the <br />music festival, which damage shall not have oc- <br />curred had the music festival not been held. Ac- <br />companying and securing said agreement shall be a <br />surety company bond in favor of fha City of Ramsey <br />andall persons to whom the applicant and-or owners <br />of the subject premises may be liable because of fha <br />above required agreement. Said bond shall be <br />prepared by a corporate bonding company <br />authorized to do business within the State of Min- <br />nesota and shall be in the amount of not less than <br />Fifty Thousand Dollars ($50,000). <br /> <br /> <br />
