RAMSEY TOWNSHIP <br />ANOKA COUNTY, MI NN ESOTA <br />OR D I NANCE NO. 74-4 <br /> <br />AN ORDINANCE REQUIRING A CERTIFICATE OF <br />OCCUPANCY FOR ANY NEWLY CONSTRUCTED <br />STRUCTURE OR STRUCTURES USED iN A <br />NON-CONFORMING MANNER AND PROVIDING <br />PENALTIES FOR FAILURE TO OBTAIN SUCH <br />CERTIFICATE. <br /> The Town Board of Supervisors of the Township of <br />Ramsay ordains: <br /> SEC~I'ION 1. PURPOSE <br /> The purpose of this ordinance is to require a cer- <br />tificate of occupancy for all new structures and tot all <br />structures used in a non-~:onforming manner within <br />Ramsey Township in order to assure that all Ramsey <br />Township ordinances are complied with prior to such <br />occupancy. <br /> SECTION 2. CERTIFICATE OF OCCUPANCY. <br /> No building or struchJre hereafter erected, sfruc. <br />lurally altered or moved, or that portion Of an existing <br />structure or.building erected or moved shall be oc- <br />cupied or used in whole or In part for any purpose <br />whalsoever unlll a certificate of occupancy shall have <br />been issued by the zoning officer stating that the <br />building or structure complies with all the Building and <br />Zoning Ordinances of the Township, as well as the <br />following requirements: <br /> a) Culvert where necessary'. If in the discretion of <br />the zoning ofticer and.or the township engineer, proper <br />drainage requires lhe use of a culvert, such culvert <br />shall be Installed In accordance with the standards and <br />specifications which have been adopted by resolution <br />of the Town Board. <br /> b) Shade Trees Required. Decldious shade trees <br />such as ash, hard maple, Norway and-or native <br />evergreen lrees with a minimum 2.inch diameter shall <br />be required at the rate of one per hundred feet of each <br />Iol'sstreet frontage. Said trees shall be located no less <br />than two (2) feet nor more than thirty (30) feet from <br />the right.of.way, and no less than five (5) feet from <br />each side yard lot line. <br /> SECTION3. REQUIRED FOR NON-CONFORMING <br />USE. <br /> NO non-conforming use shall be maintained, <br />renewed, changed or extended without a certificate of <br />occupancy having first been issued by the zoning of- <br />ficer therefor. <br /> SECTION 4. APPLIED FOR WITH PERMIT AND <br />FEE. <br /> All certificates of occupancy shall be applied for co- <br />incident wilh lhe application for a building permit. <br />Saldcerlificate shall be issued within ten days after the <br />erection, moving or alteration shall have been ap- <br />proved. The zoning officer shall make the final building <br />code and occupancy permit inspection at no further <br />cost to the applicant and upon the request of the ap. <br />pllcant. However, if at this final building code in- <br />spection~ the zoning officer delermines that further <br />items need completion prior to issuing the occupancy <br />permit~ and it is necessary for the zoning officer to <br />makeone or more return inspections, then each extra <br />inspection shall be Twenty Five and 00-100 ($25.00) <br />Dollars per inspection, payable in advance and to the <br />Township Clerk charged to the building permit ap- <br />plicant. <br /> <br /> SECTION 5. RECORD. <br /> The zoning officer shall maintain a record of all <br />certificates and copies shall be furnished upon request <br />to any person having a prop,ietary or tenancy interest <br />in the building affected. <br /> SECTION 6. MANDATORY. <br /> No permit or excavation for, or the erection or <br />alta'ation of or repairs to any building shall be issued <br />until an application has been made for a certificate of <br />occupan~:y. <br /> SECTION 7. MOVED HOUSE. <br /> A certificate of occupancy shall be issued to the <br />owners of 'the dwelling which has I~een mqved only <br />after said owner has complied~with all of:the.provisions <br />of this ordinance. <br /> SECTION 8. PENALTIES. <br /> Any person violating the provisions of this ordinance <br />shall be guilty of a misdemeanor and upon conviction <br />thereof shall be punished by a fine not to exceed Three <br />Hundred Dolwars ($300.00) or imprisonment for not to <br />exceed ninety (90) days. Each day a violation is per. <br />mitred to exist shall constitute a separate offense. <br /> SECTION 9. REPEALER. <br /> Ordinance 73-3, adopted May 1, 1973, is hereby <br />repealed~ <br /> SECTION 10. SEVERABILIT¥ CLAUSE. <br /> If any section, sub-section, clause or phrase ef this <br />ordinance is for any reason held to be unconstitutional, <br />such decision shall not affect the validity of the <br />remaining portions of this ordinance. The:Town Board <br />of the Township of Ramsey hereby declares that it <br />would have passed this ordinance, any sect(on, sub- <br />section, sentence, clause or phrase thereof, <br />irrespective of the fact that any one or more sections, <br />sub-sections, sentences, clauses or phrases be declared <br />unconstitutional. <br /> SECTION 11.
