<br />      (Al The Board Of Adjustment shall hove lhepower to
<br />      hear and decide appeals from any olher requirement,
<br />      decisions, grant or refusal made by*the Zoning Officer
<br />      in the adminislration of this Ordinance. An appeal
<br />      shell be in writing and filed in duplicate with the
<br />      Zoning Officer. Wilhin lan (10) days after filing of the
<br />      appeal, Ihe Zoning Officer shall transmit to fha Board
<br />      et Adjustment all papers involved in the PrOceedings.
<br />      Upon receipt et Ibis malarial the Board et Adjustment
<br />      shall set a hearing date and give notice by mail of the
<br />      time, place and purpose thereof to lhe appellant and to
<br />      lhe Zoning Officer. The Board of Adiustmenl may
<br />      reverse or affirm wtlolly or in Part any ruling decision
<br />      or determination and may issue or direct the issuance
<br />      of a permil, The decision Of the Board of Adjustment
<br />      may be appealed to the Township Board if the
<br />      Township Board is nol Ihe Board et Adjustment and its
<br />      decision may be appealed 1o th e Counly District Court.
<br />      CB) The Board et Adjustment upon appeal, shall
<br />      have lhe power fo oulhorize variances from the
<br />      requirements et this Ordinance, and to attach such
<br />      conditions 1o fha variance as it deems necessary fo
<br />      assure compllance with lhe purpose of this Ordinance.
<br />      A variance may be permitted if all the following
<br />      requirements are met:
<br />      1. Literal enforcement of the Ordinance would result
<br />      in undue hardship wilh respect to the property.
<br />      :2. SUCh unnecessary hardship results because of
<br />      circumstances unique Io lhe property.
<br />

<br />pollution, tire hazard or noxious emission which will
<br />disturb Or endanger neighboring properties.
<br /> Junk Yard~Land or buildings where waste,
<br />
<br />   slored, exchanged, cleared, PaCkaged, disassembled,
<br />   or handled.
<br />       Lot--A parcel of land OCCupied or capable of being
<br />   occupied by one or more Structures.
<br />       Lot of Record--Any lot which individually or as a
<br />   part et a Subdivis [on has been recorded in the Office of
<br />   the Register of Deeds of the County.
<br />       Lot, Depth of--A mean horizontal distance between
<br />   lhe front and rear lot lines.
<br />       Lot, Minimum Area OF--The measurements of a lot
<br />   compuled inclusive of any portion of lhe right of way
<br />   of any public thoroughfare.
<br />       Lot, Width of--The mean Width measured at right
<br />   angles to the depth.
<br />      Mobile Nome--Any mobile vehicle used or designed
<br />  to be used for living purposes, Whether the Wheels are
<br />  atlached or not. A travel trailer, as deferred herein,
<br />  shall be considered a mobile home if Occupied.
<br />      Planned Unit Development--A tract of land which
<br />  will contain two or more principal structures
<br />  developed under unified ownership or control, the
<br />  development of which may be unique and of a
<br />  subslantially different character than that of the
<br />  Surrounding area.
<br />      Non-Conformillg $1ructure---A structure designed,
<br />  converted or adopted for a use prior to the adoption of
<br />  provisions prohibiting such use in Such location.
<br />      Non-Conforming Use--Any use or arrangement of
<br />  land or structures legally existing at the time of
<br />  enactment of this ordinance or any of its amendments
<br />  which does nol conform to the provisions of the
<br />  Ordinance.
<br />      Public Sewer--Municipal sanitary sewerage
<br />  facililies connected to an interceptor sewer or sewage
<br />  Ireatment facility provided by the Metropolitan Sewer
<br />  Board.
<br />      Structure-Anything constructed or erected, fha use
<br />  Of which requires a fixed location on the ground or an
<br />
<br /> attachment tosomething having a fixed location on fha
<br /> ground, including, in addition to buildings, bill boards,
<br /> carports, porches, and Olher building features, hut not
<br /> including sidewalks, drives, fences and patios.
<br />     Supply Yard--A commercial establishment storing
<br /> or oflerinn for sale building supplies, steel supplies,
<br /> coal, heavy equipment, feed and grain, and similar
<br /> goods. Supply yards do not include the wrecking,
<br /> Salvaging, dismantling or storage Of automobiles and
<br /> similar vehicles.
<br />     Travel Trailers--A mobile vehicle with wheels,
<br /> designed for overnight living or camping purposes,
<br /> capable of being towed by a passenger automobile.
<br />     Yard--A required open space on a lot which is
<br /> unOccupied or unobstructed by structures from ground
<br /> level upward.
<br />     Zoning District--An area or areas for which the
<br /> regulations and requirements governing use, lot end
<br /> bulk et buildings and premises are uniform.
<br />
