1 Discretionary action. An action under this chapter related to land use that requires a public hearing by local
<br /> 2 ordinance or statute, such as preliminary plats, final subdivision plats, planned unit developments,
<br /> 3 conditional use permits, interim use permits, variances, appeals, and rezonings.
<br /> 4 Distribution Facility means an establishment where shipments of tangible personal property are processed
<br /> 5 for delivery to customers.
<br /> 6 Dock. Having the meaning given under Minnesota Rules, chapter 6115.
<br /> 7 Driveway means an onsite prepared surface traffic lane,which shall be the traffic lane leading directly from
<br /> 8 a public street to the primary garage or a parking pad or lot on the subject parcel;
<br /> 9 Dustless Surface consists of compacted bituminous millings or crushed rock. The crushed rock must all be
<br /> 10 similar in size with no fine particles.Aggregate material similar to state DOT class 5 is not considered
<br /> 11 dustless.
<br /> 12 Dwelling, manufactured home, means a structure, transportable in one or more sections, which in the
<br /> 13 traveling mode, is eight body feet or more in width and 40 body feet or more in length, or, when
<br /> 14 erected on site, is 320 or more square feet, and which is built on a permanent chassis and designated
<br /> 15 to be used as a dwelling with or without a permanent foundation when connected to the required
<br /> 16 utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained
<br /> 17 therein; except that the term includes any structure which meets all the requirements and with respect
<br /> 18 to which the manufacturer voluntarily files a certification pursuant to Minn. Stats. §§ 327.31
<br /> 19 327.36. The term"dwelling, manufactured home," does not include "recreational vehicle" as defined
<br /> 20 herein.
<br /> 21 Dwelling, multiple family, means a building designed with three or more dwelling units exclusively for
<br /> 22 occupancy by three or more families living independently of each other but sharing hallways and
<br /> 23 main entrances and exits.
<br /> 24 Dwelling, senior living, means a building designed with three or more dwelling units exclusively for
<br /> 25 occupancy where at least one of the residents in each unit is aged 55 or greater living independently
<br /> 26 of each other but sharing hallways and main entrances and exits.
<br /> 27 Dwelling, single-family detached, means a dwelling unit designed exclusively for occupancy by one family.
<br /> 28 Dwelling, Townhomes (Attached) means structures housing two e or more dwelling units contiguous to
<br /> 29 each other only by the sharing of one or more common walls; such structures are of the back-to-back
<br /> 30 or row-house type as contrasted to multiple dwelling apartment structures.
<br /> 31 Dwelling, Townhomes (Detached) means a dwelling unit not attached to another dwelling or structure and
<br /> 32 have outdoor areas and/or indoor centers that are commonly owned or maintained by a homeowners'
<br /> 33 association.
<br /> 34 Dwelling, Two-family attached, means a structure designed exclusively for occupancy by two families
<br /> 35 having separate kitchen, bathroom, and living spaces.
<br /> 36 Easement means a grant by a property owner for use of a strip of land by the public or any person for any
<br /> 37 specific purpose, or purposes of construction and maintaining utilities and/or roadways.
<br /> 38 EIFS means Exterior Insulation and Finish System.
<br /> 39 Electric power facilities. Equipment and associated facilities for generating electric power or devices for
<br /> 40 converting wind energy to electrical energy as identified and defined under Minn. Stats. § 216E.
<br /> 41 Equal degree of encroachment means a method of determining the location of floodway boundaries so that
<br /> 42 floodplain lands on both sides of a stream are capable of conveying a proportionate share of flood
<br /> 43 flows.
<br /> 44 Equipment, commercial use, means a variety of heavy machines, either specifically designed or used for
<br /> 45 commercial purposes,which perform specific construction or demolition functions, such as hoisting,
<br /> 46 excavating, hauling, grading,paving, drilling, or pile driving, under power. Trailers, either enclosed
<br /> 47 or flatbed, 6X 12 or smaller, are exempt unless they have a department of transportation certificate or
<br /> 48 number; trailers used for transport of recreational vehicles and not used for any commercial use are
<br /> 49 exempt.
<br /> 50 A licensed, self-propelled vehicle which:
<br /> 51 (1) Has a gross vehicle weight rating (GVWR) OF 10,001 pounds or more and contains print or
<br /> 52 logos which advertise a business; or
