1 Zoning district, overlay, means a zoning district containing regulations superimposed upon other zoning <br /> 2 district regulations and may supersede the underlying zoning district if more restrictive than the <br /> 3 underlying zoning district regulations. <br /> 4 Zoning district, underlying, means all zoning districts except overlay zoning districts. <br /> 5 Zoning map means the map incorporated into this chapter as a part thereof, designating the zoning districts. <br /> 6 Zoning Code means the zoning ordinance of the city, as amended from time to time by the City. <br /> 7 <br /> 8 106 Applicability and Compliance <br /> 9 From and after the effective date of the ordinance from which this chapter is derived, the use of all land and <br /> 10 every building or portion of a building erected, altered in height and area, added to, or relocated, and every <br /> 11 use within a building, or use accessory thereto, in the city shall be in conformity with the provisions of this <br /> 12 chapter and after the lawful issuance of all required permits. <br /> 13 <br /> 14 107-109 Reserved. <br /> 15 <br /> 16 110 Administration <br /> 17 Sections I I 1-140 establish the administration and enforcement powers of this chapter. <br /> 18 <br /> 19 111 Zoning Administrator <br /> 20 The zoning administrator shall: <br /> 21 (A) Administer and enforce the provisions of this chapter in accordance with its literal terms and shall <br /> 22 not have the power to permit any construction or any use or change of use which does not conform <br /> 23 to this chapter; <br /> 24 (B) Maintain the official zoning map; <br /> 25 (C) Maintain a permanent file of all zoning applications as public records. <br /> 26 <br /> 27 112-119 Reserved. <br /> 28 120 Official Zoning Map <br /> 29 (A) The boundaries of the zoning districts and overlay districts are delineated on the official zoning map, <br /> 30 which is adopted by reference and declared to be a part of this chapter. Such map shall be on <br /> 31 permanent file and available for public inspection in City Hall. It shall be the responsibility of the <br /> 32 zoning administrator to maintain and keep the map up to date and to revise or update the map with <br /> 33 each amendment thereto within 30 days after official publication of the ordinance adopting the <br /> 34 amendment. <br /> 35 (B) District and development area boundaries shown within the lines of roads, streams,and transportation <br /> 36 rights-of-way shall be deemed to follow the centerlines. The vacation of roads shall not affect the <br /> 37 location of such district or development area boundaries. When the zoning administrator cannot <br /> 38 definitely determine the location of a district or development area boundary by such centerlines, by <br /> 39 the scale or dimensions stated on the zoning map, or by the fact that it clearly coincides with a <br /> 40 property line, the zoning administrator shall interpret the location of the district or development area <br /> 41 boundary with reference to the scale of the zoning map and the purposes set forth in all relevant <br /> 42 provisions of this Code. When a district or development area boundary line divides a lot of record <br /> 43 into two or more districts or into both development areas, any portion of the lot within 50 feet of such <br /> 44 division may be used for any use of either district or development area as approved by the Planning <br /> 45 Commission or as appealed by the City Council. The Metropolitan Urban Service Area (MUSA) <br /> 46 boundary line as shown in the Comprehensive Plan, however, defines the limits of sewered areas. <br /> 47 Any area outside of the MUSA boundary shall not be served with sewer. <br /> 48 <br /> 49 121-129 Reserved. <br /> 50 <br /> 51 130 Enforcement <br /> Page 22 of 141 <br />
