The legislature of the State of Minnesota has, in Minn. Stats. ch. 103F and <br /> 6 ch. 462, delegated the responsibility to local government units to adopt regulations designed to <br /> 7 minimize flood losses. Therefore, the city council does ordain as follows. <br /> 8 (B) Purpose. <br /> 9 (1) This subdivision regulates development in the flood hazard areas of the city.These flood hazard <br /> 10 areas are subject to periodic inundation, which may result in loss of life and property, health <br /> 11 and safety hazards, disruption of commerce and governmental services, extraordinary public <br /> 12 expenditures for flood protection and relief, and impairment of the tax base. It is the purpose <br /> 13 of this Section to promote the public health, safety, and general welfare by minimizing these <br /> 14 losses and disruptions. <br /> 15 (2) National Flood Insurance Program compliance. This subdivision is adopted to comply with <br /> 16 the rules and regulations of the National Flood Insurance Program codified as 44 Code of <br /> 17 Federal Regulations Parts 59 78, as amended, so as to maintain the city's eligibility in the <br /> 18 National Flood Insurance Program. <br /> 19 (3) This subdivision is also intended to preserve the natural characteristics and functions of <br /> 20 watercourses and floodplains in order to moderate flood and stormwater impacts, improve <br /> 21 water quality, reduce soil erosion, protect aquatic and riparian habitat, provide recreational <br /> 22 opportunities, provide aesthetic benefits and enhance community and economic development. <br /> 23 <br /> 24 921 Floodplain Overlay Districts General Provisions <br /> 25 (A) This subdivision adopts the floodplain maps applicable to the city and includes three floodplain <br /> 26 districts: floodway, flood fringe, and general floodplain. <br /> 27 (1) Where floodway and flood fringe districts are delineated on the floodplain maps,the standards <br /> 28 in sections 923 or 924 will apply, depending on the location of a property. <br /> 29 (2) Locations where floodway and flood fringe districts are not delineated on the floodplain maps <br /> 30 are considered to fall within the general floodplain district. Within the general floodplain <br /> 31 district, the floodway district standards in section 923 apply unless the floodway boundary is <br /> 32 determined, according to the process outlined in section 925. Once the floodway boundary is <br /> 33 determined, the flood fringe district standards in section 924 may apply outside the floodway. <br /> 34 (B) Lands to which this subdivision applies. This subdivision applies to all lands within the jurisdiction <br /> 35 of the city shown on the official zoning map and/or the attachments to the map as being located within <br /> 36 the boundaries of the floodway, flood fringe, or general floodplain districts. <br /> 37 (1) The floodway, flood fringe and general floodplain districts are overlay districts that are <br /> 38 superimposed on all existing zoning districts.
