1 in section 923(D), if otherwise allowed in the underlying zoning district or any applicable overlay <br /> 2 district. <br /> 3 (1) Structures accessory to the uses listed in section 923(A)and the uses listed in subsections(c)(2) <br /> 4 through(9)below. <br /> 5 (2) Extraction and storage of sand, gravel, and other materials. <br /> 6 (3) Marinas, boat rentals, docks, piers, wharves, and water control structures. <br /> 7 (4) Storage yards for equipment, machinery, or materials. <br /> 8 (5) Placement of fill or construction of fences that obstruct flood flows. Farm fences, as defined in <br /> 9 section 105, are permitted uses. <br /> 10 (6) Travel-ready recreational vehicles meeting the exception standards in section 927(D)(2). <br /> 11 (7) Levees or dikes intended to protect agricultural crops for a frequency flood event equal to or <br /> 12 less than the ten-year frequency flood event. <br /> 13 (D) Standards forfloodway conditional uses: <br /> 14 (1) All uses. A conditional use must not cause any increase in the stage of the one percent chance <br /> 15 or regional flood or cause an increase in flood damages in the reach or reaches affected. <br /> 16 (2) Fill; storage of materials and equipment: <br /> 17 a. The storage or processing of materials that are,in time of flooding,flammable, explosive, <br /> 18 or potentially injurious to human, animal, or plant life is prohibited. <br /> 19 b. Fill, dredge spoil, and other similar materials deposited or stored in the floodplain must <br /> 20 be protected from erosion by vegetative cover, mulching, riprap or other acceptable <br /> 21 method. Permanent sand and gravel operations and similar uses must be covered by a <br /> 22 long-term site development plan. <br /> 23 C. Temporary placement of fill, other materials, or equipment which would cause an <br /> 24 increase to the stage of the one percent chance or regional flood may only be allowed if <br /> 25 the city has approved a plan that assures removal of the materials from the floodway <br /> 26 based upon the flood warning time available. <br /> 27 (3) Accessory structures: <br /> 28 a. Accessory structures must not be designed for human habitation. <br /> 29 b. Accessory structures, if permitted, must be constructed and placed on the building site <br /> 30 so as to offer the minimum obstruction to the flow of flood waters: <br /> 31 1. Whenever possible, structures must be constructed with the longitudinal axis <br /> 32 parallel to the direction of flood flow; and <br /> 33 2. So far as practicable, structures must be placed approximately on the same flood <br /> 34 flow lines as those of adjoining structures. <br /> 35 C. Accessory structures must be elevated on fill or structurally dry floodproofed in <br /> 36 accordance with the FP-1 or FP-2 floodproofing classifications in the Minnesota State <br /> 37 Building Code.All floodproofed accessory structures must meet the following additional <br /> 38 standards: <br /> 39 1. The structure must be adequately anchored to prevent flotation, collapse or lateral <br /> 40 movement and designed to equalize hydrostatic flood forces on exterior walls; and <br /> 41 2. Any mechanical and utility equipment in the structure must be elevated to or above <br /> 42 the regulatory flood protection elevation or properly floodproofed. <br /> 43 d. As an alternative, an accessory structure may be internally/wet floodproofed to the FP-3 or FP- <br /> 44 4 floodproofing classifications in the Minnesota State Building Code, provided the accessory <br /> 45 structure constitutes a minimal investment and does not exceed 576 square feet in size. A <br /> 46 detached garage may only be used for parking of vehicles and limited storage. All structures <br /> 47 must meet the following standards: <br /> 48 1. To allow for the equalization of hydrostatic pressure, there must be a minimum of two <br /> 49 "automatic" openings in the outside walls of the structure,with a total net area of not less <br /> 50 than one square inch for every square foot of enclosed area subject to flooding; and <br /> 51 2. There must be openings on at least two sides of the structure and the bottom of all <br /> 52 openings must be no higher than one foot above the lowest adjacent grade to the structure. <br /> Page 107 of 141 <br />
