1 If the variance does not have the effect of allowing additional bedrooms, the property owner shall <br /> 2 have a maximum of two years to upgrade the noncomplying system. <br /> 3 (D) Notifications to the department of natural resources. <br /> 4 (1) Copies of all notices of any public hearings to consider variances, zoning amendments, <br /> 5 subdivisions, or conditional uses under local shoreland management controls must be sent to <br /> 6 the commissioner or the commissioner's designated representative and postmarked at least ten <br /> 7 days before the hearings. Notices of hearings to consider proposed subdivisions/plats must <br /> 8 include copies of the subdivision/plat. <br /> 9 (2) A copy of approved amendments and subdivisions/plats, and final decisions granting variances <br /> 10 or conditional uses under local shoreland management controls must be sent to the <br /> 11 commissioner or the commissioner's designated representative and postmarked within ten days <br /> 12 of final action. When a variance is approved after the department of natural resources has <br /> 13 formally recommended denial in the hearing record, the notification of the approved variance <br /> 14 shall also include the board of adjustment's summary of the public record/testimony and the <br /> 15 findings of fact which supported the issuance of the variance. <br /> 16 <br /> 17 942 Shoreland Classification System and Land Use Districts; Shoreland Management <br /> 18 (A) Shoreland classification system. <br /> 19 (1) The public waters of the city have been classified in subsection(a)(2)of this section consistent <br /> 20 with the criteria found Minn. Rules pt. 6120.3300, and the public waters inventory map for the <br /> 21 county. In order to guide the wise development and utilization of shorelands of public waters <br /> 22 for the preservation of water quality, natural characteristics, economic values and the general <br /> 23 health, safety and welfare, certain public waters in the city have been given a shoreland <br /> 24 management classification. <br /> 25 (2) These public waters of the city have been classified by the commissioner of natural resources <br /> 26 as follows: <br /> Natural Environment Lakes DNR I.D. # <br /> a.
