CC Regular Session Meeting Date: 11/14/2023 Primary Strategic Plan Initiative: Not Applicable Information Title: Introduce Ordinance#23-20,Amendment to Chapter 26, Licenses, Permits, and Miscellaneous Business Regulations,Article XVI. Tobacco,Division 2, Section 26-787(6) Purpose/Background: On January 31 st of each year,tobacco licenses are due for annual renewal. Recently, city staff received two (2) tobacco license applications for the same address; one application was for the existing tenant and the other application was for a new tenant. City staff have not encountered this situation in the past. The city code does not specifically address the number of tobacco licenses allowed for each property, so staff consulted with the City Attorney. Mr. Knaak recommends the city code be amended to allow only one tobacco license to be issued for any given location or address. Ordinance#23-20 amends the city code to read"Only one license may be issued for any given location or address." Notification: Notif caiton not required. Time Frame/Observations/Alternatives: If the City Council introduces the Ordinance#23-20,then formal adoption will be recommended at the November 28, 2023 City Council meeting. After formal adoption, the ordinance will become effective 30 days after publication. Alternative: 1. City Council could introduce Ordinance#23-20, as presented. 2. City Council could introduce Ordinance#23-20,with changes. 3. City Council could deny the introduction. Funding Source: Not Applicable Recommendation: Staff recommends the introduction of Ordinance#23-20. Outcome/Action: Make a motion to introduce an amendment to Ordinance#23-20 Chapter 26, Licenses, Permits, and Miscellaneous Regulations,Article XVI.
