11. That there is no flat area in the rear yard of the Subject Property that would be sufficient <br />to place the Accessory Structure without impeding drainage. <br />12. That the Permittee constructed the accessory structure prior to first obtaining a zoning <br />permit. <br />13. That the Accessory Structure measures at eight feet by ten feet (8' x 10'), which calculates <br />to eighty (80) square feet in area. <br />14. That the Accessory Structure is not readily visible from surrounding properties due to <br />landscape screening. <br />FINDINGS OF FACT <br />1. That the Accessory Structure does not impair an adequate supply of light and air to <br />adjacent property. <br />2. That the Accessory Structure does not unreasonably increase the congestion on the public <br />street. <br />3. That the Accessory Structure does not have the effect of allowing any use prohibited in <br />the R-1 A, Single -Family Residential District. <br />4. That the Accessory Structure does not permit a lesser degree of public health, safety, and <br />general welfare protection than established by Chapter 106 of the Ramsey City Code, or <br />permit standards which are lower than those required by state law. <br />5. That the Accessory Structure does not violate the intent and purpose of the <br />Comprehensive Plan. <br />6. That the Accessory Structure will be in accordance with the objectives of the intent of <br />Section 106-220 (Variances) of the Ramsey City Code. <br />7. That the Accessory Structure, other than the front yard setback, is in substantial <br />compliance with all applicable codes in Section 106 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />That the Ramsey Planning Commission hereby grants approval of a variance (the "Variance") to <br />deviate from the required Accessory Structure setback from the front property line to allow an <br />Accessory Structure to be located with a fifteen -foot (15') front setback on the Subject Property, <br />subject to review and approval as to legal form and contingent upon the following conditions: <br />RESOLUTION #23-294 <br />Page 2 of 4 <br />
