SECTION 12 Drug Free Workplace Policy <br /> 12.1 Drug Free Workplace Policy Statement <br /> In accordance with the "Drug-Free Workplace Act of 1988", the city of Ramsey hereby notifies <br /> its employees that the unlawful manufacture, distribution, dispensing, possession or use of a <br /> controlled substance, as defined by law, is prohibited at the cand in the course of any activities <br /> performed in conjunction with the employee's work-related responsibilities. It is important to <br /> note that not only is the use of illegal drugs unlawful, but also the illegal dispensing of legal <br /> (prescription) drugs. <br /> As a condition of employment with the city of Ramsey, all employees will abide by the terms of <br /> this Drug-Free Workplace Policy and will notify the City Human Resources Manager in writing <br /> of any criminal drug arrest or conviction no later than five days after such arrest or conviction. <br /> Employees who violate this policy may be subject to disciplinary actions which may include <br /> suspension or immediate termination. <br /> Employees who are convicted of a drug related violation in the workplace or while engaged in <br /> work-related responsibilities maybe required to participate in a drug abuse assistance or <br /> rehabilitation program approved for such purposes by a federal, state, or local health, law <br /> enforcement, or other appropriate agency. Appropriate personnel action shall be taken against <br /> such convicted employee up to and including termination of employment. The City reserves the <br /> right to terminate any employee who has been arrested for, pled guilty to, or convicted of any <br /> crime involving the operation of a motor vehicle under the influence of illegal drugs, alcohol, or <br /> other controlled substances. This includes all such crimes occurring outside of work hours and <br /> all such crimes involving the use of any vehicle owned or leased by the City, the employee's <br /> personal vehicle, or any other vehicle. <br /> Employees are also encouraged to attend one of the drug-free awareness programs which may be <br /> offered periodically. Other parts of the drug-free program may include drug counseling and <br /> employee assistance programs in the future. <br /> 12.2 Drug and Alcohol Testing <br /> General Policy: It is the policy of the City to provide adrug-free environment. The City's goal is <br /> to establish and maintain a healthy and efficient workforce free from the effects of drug and alcohol <br /> abuse in compliance with the requirements of the federal Drug-Free Workplace Act of 1988 and <br /> other applicable state and federal law. <br /> The City recognizes drug and alcohol abuse as potential health, safety and security problems. <br /> Employees needing help in dealing with drug and alcohol problems are encouraged to make use of <br /> the medical resources available through their health insurance plans. <br /> Employees are required to report to work on time and in appropriate mental and physical <br /> condition for work.
