Scope: This drug and alcohol testing policy applies to all employees of the <br /> City and to all job applicants who have received a conditional offer of <br /> employment by the City. <br /> (c) Application of Law: All drug and alcohol testing shall conform to the <br /> requirements of applicable state and federal law. To the extent that any <br /> provision of this policy conflicts with such law,the law is controlling. <br /> Employees Subject to Federal Testing Requirements: Federal law imposes <br /> specific drug and alcohol testing requirements for employees holding <br /> certain types of driver's licenses or engaging in certain duties. All testing <br /> for such employees will comply with the federal requirements, which may <br /> be more strict, or different than, the procedures described in this policy. <br /> The City will also follow all federally required procedures regarding the <br /> results of such testing. <br /> Definitions: For purposes of the Policy,the following definitions will apply,unless such definitions <br /> are inconsistent with applicable law. In the event of such a conflict, the terms will be given the <br /> meaning imposed by law: <br /> • Alcohol: Ethyl alcohol. <br /> • Confirmatory Test and Confirmatory Retest: A drug or alcohol test that uses a method of <br /> analysis authorized by Minnesota law for providing specific data as to the drugs, alcohol, <br /> or their metabolites detected in an initial screening test. <br /> • Conviction: A finding of guilty(including a plea of guilty or"nolo contenders") or <br /> imposition of sentence, or both,by any judicial body charged with the responsibility to <br /> determine violations of state or federal <br /> • Drua,: A controlled substance as defined in applicable law. <br /> • Drug and Alcohol Testing,Drug or Alcohol Testing, and Drug or Alcohol Test: Analysis of <br /> a body component sample in a manner consistent with Minnesota law for the purpose of <br /> measuring the presence or absence of drugs, alcohol, or their metabolites in the sample <br /> tested. <br /> • Drug Paraphernalia: An item or items described as drug paraphernalia in Minnesota State <br /> law. <br /> • Employee: A person, independent contractor, or person working for an independent <br /> contractor who performs services for compensation, in whatever form, for the City. <br /> "Employee" shall also mean a volunteer who provides services to the City for no or <br /> nominal compensation. <br /> • Employer: The city of Ramsey acting through its designees of the City Council. <br /> • Initial Screening Test: A drug or alcohol test which uses a method of analysis authorized <br /> by Minnesota law, as being capable of providing data as to general classes of drugs, <br /> alcohol, or their metabolites. <br /> 771Page <br />
