The applicant shall prove that the use as proposed in the conditional use permit application would not result <br />in any detrimental effects as per the criteria listed in this subsection (e). <br />(f) Conditions of approval. In approving an application for a conditional use permit, the city may attach <br />conditions and restrictions as it finds necessary, including but not limited to the following: <br />(1) Restrictions on the number and type of animals. <br />(2) Setbacks greater than those required in section 10-127 <br />(3) Minimum and/or maximum distance between primary and secondary enclosures. <br />(4) Minimum height of enclosures. <br />(5) Size of the enclosures. <br />Expiration. A conditional use permit shall remain in effect as long as the conditions agreed upon are <br />observed and the permit holder is in compliance with all other regulations or standards of this chapter. <br />(g) <br />(h) <br />w mwm,r old141 <br />Section 117-111 is amended to revise the following language (added language underlined, deleted <br />language strike through): <br />(c) Uses permitted by conditional use permit. <br />(1) Religious institutions. <br />(2) Commercial horse boarding. <br />(3) Commercial dog kennels. <br />(4) Oversizing of accessory structure size. <br />(5) Two-story accessory buildings. <br />(6) Cemeteries. <br />(7) Essential services. <br />(8) Cell towers in Tower Overlay District. <br />(9) Commercial garden nurseries or greenhouses with buildings. <br />(10) Micro -scale WECS. <br />SECTION 3. SUMMARY <br />The following is the official summary of Ordinance #15-12, which has been approved by the City Council <br />of the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br />It is the intent and effect of Ordinance #15-12 to amend Ramsey, Minnesota City Code Chapters 10 & 117 <br />to replace the conditional use permit process for four (4) or more dogs, beekeeping, and other non- <br />traditional domestic animals with a license process and eliminate the need for a conditional use permit to <br />maintain horses on 1.5 to 2.99 acres. The intent is to reduce the time and the costs to owners to obtain these <br />approvals while still providing for public comment where necessary. <br />SECTION 4. EFFECTIVE DATE <br />The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to City <br />Page 23 <br />
