1 (1) Pznpose. To establish standards that sustain and enhance the biological and ecological <br />2 functions of vegetation; preserve the natural character and topography of the MRCCA; and <br />3 maintain stability of bluffs and steep slopes and ensure stability of other erosion -prone areas. <br />4 (2) Applicability. This section applies to: <br />5 a. Shore impact zones; <br />6 b. Areas within 50 feet of a wetland or natural drainage way; <br />7 c. Bluff impact zones; <br />8 d. Areas of native plant communities; and <br />9 e. Significant existing vegetative stands identified in the MRCCA plan. <br />10 (3) Activities allowed without a vegetation permit. <br />11 a. Maintenance of existing lawns, landscaping and gardens; <br />12 b. Removal of vegetation in emergency situations as determined by the City of Ramsey; <br />13 c. Right-of-way maintenance for public facilities; <br />14 d. Agricultural and forestry activities; <br />15 e. Selective vegetation removal, provided that vegetative cover remains consistent with the <br />16 management purpose of the MRCCA District, including: <br />17 1. Vegetation that is dead, diseased, dying, or hazardous; <br />18 2. To prevent the spread of diseases or insect pests; <br />19 3. Individual trees and shrubs; and <br />20 4. Removal of invasive non-native species. <br />21 (4) Activities allowed with a vegetation permit. <br />22 a. The following intensive vegetation clearing activities are allowed with a vegetation <br />23 permit: <br />24 1. Clearing of vegetation that is dead, diseased, dying, or hazardous. <br />25 2. Clearing to prevent the spread of diseases or insect pests. <br />26 3. Clearing to remove invasive non-native species. <br />27 4. Clearing to prepare for restoration and erosion control management activities <br />28 consistent with a plan approved by City of Ramsey. <br />29 5. The minimum necessary for development that is allowed with a building peiniit or <br />30 as an exemption under section 920(L). <br />31 b. Conditions of vegetation permit approval: <br />32 1. Development is sited to minimize removal of or disturbance to natural vegetation; <br />33 2. Soil, slope stability, and hydrologic conditions are suitable for the proposed work <br />34 as determined by a professional engineer or City of Ramsey; <br />35 3. Clearing is the minimum necessary and designed to blend with the natural terrain <br />36 and minimize visual impacts to public river corridor views; <br />37 4. Any native plant communities removed are replaced with vegetation that provides <br />38 equivalent biological and ecological functions consistent with an approved <br />39 vegetation restoration plan. If replaced, priorities for restoration are stabilization <br />40 of erodible soils, restoration or enhancement of shoreline vegetation, and <br />41 revegetation of bluffs or steep slopes visible from the river; <br />42 5. All other vegetation removed is restored with natural vegetation to the greatest <br />43 extent practicable consistent with an approved vegetation restoration. <br />44 6. Any disturbance of highly erodible soils is replanted with deep-rooted vegetation <br />45 with a high stem density; <br />46 7. Vegetation removal activities are conducted so as to expose the smallest practical <br />47 area of soil to erosion for the least possible time; <br />48 8. Areas of vegetation restoration priorities identified in the MRCCA plan are <br />49 restored, if applicable; and <br />50 9. Any other condition determined necessary to achieve the purpose of this section. <br />51 (5) Prohibited activities.
