1 a. To protect and enhance the natural and scenic values of the MRCCA during development <br />2 or redevelopment of the remaining large sites; <br />3 b. To establish standards for protecting and restoring biological and ecological functions of <br />4 primary conservation areas on large sites; and <br />5 c. To encourage restoration of natural vegetation during development or redevelopment of <br />6 large sites where restoration opportunities have been identified in MRCCA plans. <br />7 (2) Applicability. <br />8 a. The design standards in this section apply to subdivisions, planned unit developments <br />9 and master -planned development and redevelopment of land involving ten or more acres <br />10 for contiguous parcels that abut the Mississippi River and 20 or more acres for all other <br />11 parcels, including smaller individual sites within the following developments that are <br />12 part of a common plan of development that may be constructed at different times: <br />13 1. Subdivisions; <br />14 2. Planned unit developments; and <br />15 3. Master -planned development and redevelopment of land. <br />16 b. The following activities are exempt from the requirements of this section: <br />17 1. Minor subdivisions consisting of three or fewer lots; <br />18 2. Minor boundary line corrections; <br />19 3. Resolutions of encroachments; <br />20 4. Additions to existing lots of record; <br />21 5. Placement of essential services; and <br />22 6. Activities involving river -dependent commercial and industrial uses. <br />23 (4) Design standards. <br />24 a. Primary conservation areas, where they exist, must be set aside and designated as <br />25 protected open space in quantities meeting the following as a percentage of total parcel <br />26 area: <br />27 1. CA-ROS District: 50 percent; <br />28 2. CA -RN District: 20 percent; <br />29 3. CA -SR District: Ten percent if the parcel includes native plant communities or <br />30 provides feasible connections to a regional park or trail system, otherwise no <br />31 requirement. <br />32 b. If the primary conservation areas exceed the amounts specified in section 920(K)(4)a <br />33 above, then protection of native plant communities and natural vegetation in riparian <br />34 areas shall be prioritized. <br />35 c. If primary conservation areas exist but do not have natural vegetation (identified as <br />36 restoration priorities in the MRCCA plan), then a vegetation assessment must be <br />37 completed to evaluate the unvegetated primary conservation areas and determine <br />38 whether vegetation restoration is needed. <br />39 d. If primary conservation areas do not exist on the parcel and portions of the parcel have <br />40 been identified in the MRCCA plan as a restoration area, vegetation must be restored in <br />41 the identified areas and the area must be set aside and designated as protected open space. <br />42 e. Stoll water treatment areas or other green infrastructure may be used to meet the <br />43 protected open space requirements if the vegetation provides biological and ecological <br />44 functions. <br />45 f. Land dedicated under this section for public river access, parks, or other open space, or <br />46 public facilities may be counted toward the protected open space requirement. <br />47 g. Protected open space areas must connect open space, natural areas, and recreational <br />48 areas, where present on adjacent parcels, as much as possible, to form an interconnected <br />49 network. <br />50 (5) Permanent protection of designated open space. <br />51 a.
