1 Using human intervention to open a garage door prior to flooding will not satisfy this <br />2 requirement for automatic openings. <br />3 (4) Structural works for flood control that will change the course, current or cross section of <br />4 protected wetlands or public waters are subject to the provisions of Minn. Stats. § 103G.245. <br />5 (5) A levee, dike or floodwall constructed in the floodway must not cause an increase to the one <br />6 percent chance or regional flood. The technical analysis must assume equal conveyance or <br />7 storage loss on both sides of a stream. <br />8 (6) Floodway developments must not adversely affect the hydraulic capacity of the channel and <br />9 adjoining floodplain of any tributary watercourse or drainage system. <br />10 <br />11 924 Flood Fringe District (FF) <br />12 (A) Permitted uses. Peiuiitted uses are those uses of land or structures allowed in the underlying zoning <br />13 district(s) that comply with the standards in subsection (b) below. <br />14 (B) S'tandards for flood fringe permitted uses. <br />15 (1) All structures, including accessory structures, must be elevated on fill so that the lowest floor, as <br />16 defined, is at or above the regulatory flood protection elevation. The finished fill elevation for <br />17 structures must be no lower than one foot below the regulatory flood protection elevation and <br />18 the fill must extend at the same elevation at least 15 feet beyond the outside limits of the structure. <br />19 a. All service utilities, including ductwork, must be elevated or water -tight to prevent infiltration <br />20 of floodwaters. <br />21 b. As an alternative to elevation on fill, an accessory structure that constitutes a minimal <br />22 investment and that does not exceed 576 square feet in size may be internally floodproofed in <br />23 accordance with section 923(D)(3). <br />24 (2) The cumulative placement of fill or similar material on a parcel must not exceed 1,000 cubic <br />25 yards, unless the fill is specifically intended to elevate a structure in accordance with subsection <br />26 (a) above, or if allowed as a conditional use under section 924(C)(3) below. <br />27 (3) The storage of any materials or equipment must be elevated on fill to the regulatory flood <br />28 protection elevation. <br />29 (4) The storage or processing of materials that are, in time of flooding, flammable, explosive, or <br />30 potentially injurious to human, animal, or plant life is prohibited. <br />31 (5) Fill must be properly compacted and the slopes must be properly protected by the use of riprap, <br />32 vegetative cover or other acceptable method. <br />33 (6) All new principal structures must have vehicular access at or above an elevation not more than <br />34 two feet below the regulatory flood protection elevation, or must have a flood <br />35 warning/emergency evacuation plan acceptable to the city. <br />36 (7) Accessory uses such as yards, railroad tracks, and parking lots may be at an elevation lower than <br />37 the regulatory flood protection elevation. However, any facilities used by employees or the <br />38 general public must be designed with a flood warning system that provides adequate time for <br />39 evacuation if the area is inundated to a depth and velocity such that the depth (in feet) multiplied <br />40 by the velocity (in feet per second) would exceed a product of four upon occurrence of the <br />41 regional (one percent chance) flood. <br />42 (8) Interference with noinial manufacturing/industrial plant operations must be minimized, <br />43 especially along streams having protracted flood durations. In considering permit applications, <br />44 due consideration must be given to the needs of industries with operations that require a <br />45 floodplain location. <br />46 (9) Flood fringe developments must not adversely affect the hydraulic capacity of the channel and <br />47 adjoining floodplain of any tributary watercourse or drainage system. <br />48 (10) Manufactured homes and recreational vehicles must meet the standards of section 927. <br />49 (C) Conditional uses. The following uses and activities may be allowed as conditional uses, if allowed in <br />50 the underlying zoning district(s) or any applicable overlay district, following the procedures in section <br />51 928(D). conditional uses must meet the standards in subsections (D)(4) through (10) above and section <br />52 924(D). <br />Attachment A — Ordinance #23-14 <br />Page 108 of 141 <br />
