1 7 The appearance of open space areas, including topography, vegetation, and <br />2 allowable uses, must be preserved by use of restrictive deed covenants, permanent <br />3 easements, public dedication and acceptance, or other equally effective and <br />4 permanent means; and <br />5 8. The shore impact zone, based on normal structure setbacks, must be included as <br />6 open space. For residential PUDs, at least 50 percent of the shore impact zone area <br />7 of existing developments or at least 70 percent of the shore impact zone area of <br />8 new developments must be preserved in its natural or existing state. For <br />9 commercial PUDs, at least 50 percent of the shore impact zone must be preserved <br />10 in its natural state. <br />11 c. Erosion control and stormwater management. Erosion control and stormwater <br />12 management plans must be developed and the PUD must: <br />13 1. Be designed, and the construction managed, to minimize the likelihood of serious <br />14 erosion occurring either during or after construction. This must be accomplished <br />15 by limiting the amount and length of time of bare ground exposure. Temporary <br />16 ground covers, sediment entrapment facilities, vegetated buffer strips, or other <br />17 appropriate techniques must be used to minimize erosion impacts on surface water <br />18 features. Erosion control plans approved by a soil and water conservation district <br />19 may be required if project size and site physical characteristics warrant; and <br />20 2. Be designed and constructed to effectively manage reasonably expected quantities <br />21 and qualities of stormwater runoff. Impervious surface coverage within any tier <br />22 must not exceed 25 percent of the tier area, except that for commercial PUDs 35 <br />23 percent impervious surface coverage may be allowed in the first tier of general <br />24 development lakes with an approved stormwater management plan and <br />25 consistency with this subdivision. <br />26 d. Centralization and design of facilities. Centralization and design of facilities and <br />27 structures must be done according to the following standards: <br />28 1. Planned unit developments must be connected to publicly owned water supply and <br />29 sewer systems, if available. On -site water supply and sewage treatment systems <br />30 must be centralized and designed and installed to meet or exceed applicable <br />31 standards or rules of the state department of health and this subdivision. On -site <br />32 sewage treatment systems must be located on the most suitable areas of the <br />33 development, and sufficient lawn area free of limiting factors must be provided for <br />34 a replacement soil treatment system for each sewage system; <br />35 2. Dwelling units or sites must be clustered into one or more groups and located on <br />36 suitable areas of the development. They must be designed and located to meet or <br />37 exceed the following dimensional standards for the relevant shoreland <br />38 classification: setback from the ordinary high water level, elevation above the <br />39 surface water features, and maximum height. Setbacks from the ordinary high <br />40 water level must be increased in accordance with this subdivision for developments <br />41 with density increases; <br />42 3. Shore recreation facilities, including but not limited to swimming areas, docks, and <br />43 watercraft mooring areas and launching ramps, must be centralized and located in <br />44 areas suitable for them. Evaluation of suitability must include consideration of land <br />45 slope, water depth, vegetation, soils, depth to groundwater and bedrock, or other <br />46 relevant factors. The number of spaces provided for continuous beaching, mooring, <br />47 or docking of watercraft must not exceed one for each allowable dwelling unit or <br />48 site in the first tier (notwithstanding existing mooring sites in an existing <br />49 commercially used harbor). Launching ramp facilities, including a small dock for <br />50 loading and unloading equipment, may be provided for use by occupants of <br />51 dwelling units or sites located in other tiers; <br />Attachment A — Ordinance #23-14 <br />Page 131 of 141 <br />
