								    1 Adult uses accessory means a use, business, or establishment having ten percent of its stock in trade or 
<br />2 floor area allocated to, or 20 percent of its gross receipts derived from movie rentals or magazine sales. 
<br />3 Adult uses principal means a use, business, or establishment having more than ten percent of its stock in 
<br />4 trade or floor area allocated to, or more than 20 percent of its gross receipts derived from, any adult 
<br />5 use. 
<br />6 Agricultural use means the raising, cultivation, drying, or storage of agricultural products for sale, or the 
<br />7 storage of machinery or equipment currently used in support of agricultural production by the same 
<br />8 faini entity in addition to the production for sale of livestock, dairy animals, dairy products, poultry or 
<br />9 poultry products, fur bearing animals, horticultural or nursery stock, fruit, vegetables, forage, grains, or 
<br />10 bees and apiary products. Wetlands, pasture, and woodlands accompanying land in agricultural use 
<br />11 shall be deemed to be in agricultural use. 
<br />12 Alternative design. Subdivision design methods such as conservation design, transfer of development 
<br />13 density, or similar zoning and site design techniques that protect open space and natural areas. 
<br />14 Amortization means the establishment of a time schedule over which the cost of an investment is 
<br />15 depreciated. 
<br />16 Animal Service Business means a business that provides veterinary care, grooming, training, and/or 
<br />17 boarding to pets and animals. 
<br />18 Applicant means a person who is applying for a land use application approval as required by this chapter. 
<br />19 The term "applicant" also means that person's agents, employees, and others acting under this person's 
<br />20 direction. 
<br />21 Assisted Living, Memory Care, and Nursing Home Facilities means a state -licensed residential structure 
<br />22 where varying levels of medical care are provided for its residents. 
<br />23 Attached (structures) means structures physically sharing foundations and walls. 
<br />24 Auto salvage. See Vehicle wrecking yard. 
<br />25 Barge fleeting. Temporarily parking and securing barges on the river, on or off channel, while tows are 
<br />26 assembled or broken up. 
<br />27 Base flood elevation means the elevation of the "regional flood". The term "base flood elevation" is used 
<br />28 in the flood insurance study. 
<br />29 Basement means any area of a structure, including crawl spaces, having its floor or base subgrade (below 
<br />30 ground level) on all four sides, regardless of the depth of excavation below ground level. 
<br />31 Berm means an earthen mound designed to provide visual interest, screen undesirable views, and/or 
<br />32 decrease noise. 
<br />33 Best management practices (BMPs) means erosion and sediment control and water quality management 
<br />34 practices that are the most effective and practicable means of controlling, preventing, and minimizing 
<br />35 degradation of surface water, including construction -phasing, minimizing the length of time soil areas 
<br />36 are exposed, prohibitions, and other management practices published by state or designated area -wide 
<br />37 planning agencies. (Refer to the current versions of the Minnesota Pollution Control Agency's 
<br />38 publications, "Protecting Water Quality in Urban Areas," and, "Stoini-Water and Wetlands: Planning 
<br />39 and Evaluation Guidelines for Addressing Potential Impacts of Urban Stoini-Water and Snow -Melt 
<br />40 Runoff on Wetlands," the United States Environmental Protection Agency's, "Stormwater Management 
<br />41 for Construction Activities: Developing Pollution Prevention Plans and Best Management Practices," 
<br />42 and the state department of transportation's, "Erosion Control Design Manual" for suitable BMPs.) 
<br />43 Biological and ecological functions. The functions of vegetation in stabilizing soils and slopes, retaining 
<br />44 and filtering runoff, providing habitat, and recharging groundwater. 
<br />45 Bluff (Shoreland) means a topographic feature such as a hill, cliff, or embankment having the following 
<br />46 characteristics (an area with an average slope of less than 18 percent over a distance for 50 feet or 
<br />47 more shall not be considered part of the bluff): 
<br />48 (1) Part or all of the feature is located in a shoreland area; 
<br />49 (2) The slope rises at least 25 feet above the ordinary high water level of the water body; 
<br />50 (3) The grade of the slope from the toe of the bluff to a point 25 feet or more above ordinary high 
<br />51 water level average 30 percent or greater; and 
<br />52 (4) The slope must drain toward the waterbody.
