#I0 and Ramsey Blvd. is operational. Fire Chief Dean Kapler is supportive of the developer's <br />request fi'om a public safety standpoint. Staff recommended final plat approved contingent upon <br />compliance with City Staff Review Letter dated March 7, 2003 and the Developer and the City <br />entering into a Development Agreement. It was noted that the Development Agreement is <br />drafted to restrict building permits and certificate of occupancies to the first five structures. Ms. <br />Wald noted that #9 in the development agreement should include the credit amount of $55,620. <br /> <br />Mayor Gamec inquired if the Council was comfortable with allowing the first five units to be <br />constructed prior to the upgrade of Highway #10 and Ramsey Boulevard. <br /> <br />Dave Schulte, Turtle Moon, Inc., explained that the light installation is going to take awhile <br />because of MnDOT's requirements and they would like the opportunity to begin construction this <br />spring and build through the summer so that they have some units completed for the fall Parade <br />of Homes. <br /> <br />Consensus of the Council was to allow for five units to be constructed prior to the completion of <br />the upgrade of Highway #10 and Ramsey Boulevard. <br /> <br />Councilmember Elvig expressed concern with people moving into the new development and then <br />there is a dispute with the residents as to what is going to be developed across the street. He <br />stated that he wants to make sure that people moving into the development understand that the <br />property across the street is eligible for commercial uses. <br /> <br />Mi;. Schulte replied that they could provide that information in the model, noting the builder will <br />be Pulte Homes. He noted that the outlot is designated as mixed use development and they <br />would be looking at a retail center and office space. <br /> <br />Councilmember Strommen inquired if there were some guarantees that density transition and <br />landscaping issues are being addressed. <br /> <br />Associate Planner Wald replied that those issues were addressed as part of preliminary plat <br />approval. <br /> <br />Councihnember Strommen inquired if the City was using the most current tree list when <br />reviewing landscaping plans. <br /> <br />Associate Planner Wald explained that staff had not used the list currently drafted by the <br />Environmental Policy Task Force, but all the species being proposed are included on that list. <br /> <br />Councilmember Kurak inquired if the extension of Ramsey Boulevard will encroach on the <br />County property. <br /> <br />City Engineer Jankowski explained that 100 feet of right of way will be needed with 40 feet <br />going to the west of the center line and 60 feet to the east. There will be sufficient right of way <br />to accommodate the ultimate section to the extent that the developer can dedicate.
