5. 16. <br /> CC Regular Session <br /> Meeting Date: 12/12/2023 <br /> Primary Strategic Plan Initiative: Promote economic growth and development. <br /> Information <br /> Title <br /> Adopt Resolution#23-307 Approving the Final Plat and Development Agreement for Lynwood Third Addition <br /> (Project No. 23-121); case of U.S. Home, LLC dba Lennar <br /> Purpose/Background: <br /> The City has received an application from Lennar(the "Applicant") for Final Plat approval of Lynwood Third <br /> Addition,which is the third and final phase of Lynwood, located south and west of Fire Station#1 (the "Subject <br /> Property"). The final phase of this development consists of twelve (12) single family residential lots. <br /> Notification: <br /> Notification is not required for consideration of a final plat. <br /> Observations/Alternatives: <br /> This is the third and final phase of the Lynwood subdivision. It includes twelve(12) single family residential lots <br /> in the northwest corner of the Subj ect Property. This portion of the Subject Property is zoned R-1 Residential <br /> (MUSA) - 80 (R-I A for the new Zoning Code). The new lots would abut existing single family residential lots, <br /> which are zoned R-1 Residential (Rural Developing) or Rural Residential(RR in the new Zoning Code). <br /> However,there are two outlots between the new lots and the existing neighborhood lots. These are being created <br /> to satisfy the density transitioning requirements. <br /> As part of the approval of the Preliminary Plat for Lynwood,two (2)variances were approved. The first variance <br /> allowed slightly smaller lot sizes for Lots 3-4 and 8-11 (lot sizes ranging between 0.20 acres and 0.22 acres). Had <br /> the outlots not been platted,these lots all would have met or exceeded the minimum lot size of 0.25 acres. The <br /> second variance allowed a minimum front yard setback of twenty-five (25) feet. This helped keep slightly more <br /> separation between the new lots and the existing homes to the north and west and also maintained a consistent <br /> front yard setback with the townhomes in the first and second additions. The Final Plat matches the approved <br /> Preliminary Plat. <br /> Alternatives <br /> Alternative 1: Approve the Final Plat and Development Agreement for Lynwood Third Addition. The Final Plat <br /> is consistent with the approved Preliminary Plat. Almost all the landscaping serving as density transitioning has <br /> been installed,with the remainder to be installed after the storm sewer work in Outlots A&B is complete. Staff <br /> supports this alternative. <br /> Alternative 2: Do not approve the Final Plat and Development Agreement for Lynwood Third Addition based on <br /> certain findings. As noted,the Final Plat is consistent with the approved Preliminary Plat. There would be no <br /> legal basis for denial. Staff does not support this alternative. <br /> Funding Source: <br /> The Applicant is responsible for all costs associated with this applicatton. <br /> Recommendation: <br />
