Whenever a Party <br /> y determines that conditions within its jurisdiction require specialized <br /> 3 <br /> q <br /> support in handling critical field operations, where intense <br />� pp g p a <br /> negotiations or special tactical deployment methods appear to be <br /> necessary, the Part may request that the Anoka count Sheriff:or <br /> k rY Y Y q Y <br /> his or her designee deploy ACSo-SWAT to assist the Party. Upon <br />� g p Y Y <br /> a request for assistance, ACSo-SWAT may be dispatched to the <br /> Requesting Party's jurisdiction, in accordance with ACSo-SWAT <br /> policy.. The Team commander or A s s i sta n t commander <br /> I <br /> shall notify the chief Deputy of the ACSo of any request for <br /> f assistance. No Party or individual member of ACSo-SWAT shall <br /> incur any liability based upon a refusal to respond. In addition, <br /> to once deployed, the Team commander or Assistant <br /> E pY i <br /> Commander may at anytime and in his or her sole judgment <br /> recall the Team. The decision to recall a Team <br /> deployed pursuant <br /> nt ill not result in liability to an Part or to the <br /> to this Agreement w b y y y ; <br /> Team commander or A s s i s t a n t commander who recalled the <br /> f Tea-m, -- <br /> r 1 <br />{ 5.2.3 Direction and Control. Personnel and p <br /> equipment rovided <br /> pursuant to this Agreement shall remain the personnel and property <br /> of the Fart providing the same. The Requesting Fart will be in t <br /> Party � a � Y <br /> control of the scene. However tactical command will remain with <br /> the ACSo-SWAT commander or their designee. Nothing in this <br /> provision shall limit the Team commander's ability to establish Team <br /> Member protocol to take emergency action in response to immediate <br /> i threats to an officer or public safety in accordance with the law. <br /> � Y � <br /> 5.2.4 Compensation. when the ACSo-SWAT provides services to a <br /> Requesting Party, the Team Members of the ACSo-SWAT shall be <br /> compensated by their respective employers just as if they were <br /> performing the duties within and for the jurisdiction of their <br /> employers. No charges will be levied by the ACSo-SWAT or by the <br /> Parties for specialized response operations provided to a <br /> Y------ ------------- --- - - ---- -- -- 'Request n.g--.--Party_---pursua_.nt- to this Agreement.--If the -assistance <br /> provided pursuant to this Agreement is reimbursable b an outside <br />� p p g Y <br /> source, any Party whose officers provided assistance for the ACSo- <br /> SWAT may submit itemized bills for the actual cost of any assistance <br /> provided, including salaries, overtime, materials, and supplies, to the <br /> ACSO-SWAT Team commander. The ACSo-SWAT shall submit <br /> the invoices to the reimbursing entity. The reimbursing entity shall <br /> reimburse the ACSo-SWAT for the actual cost, and the ACSo" <br /> SWAT shall forward the reimbursement to the Responding Party. <br />
