Commissioner Bauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #23-294 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ACCESSORY <br />STRUCTURE SETBACKS AT 6070 143" LANE NW AND DECLARING TERMS OF <br />SAME <br />RECITALS <br />1. The City of Ramsey received an application from Nick Larson (the "Permittee") <br />requesting a Variance to the minimum front yard accessory structure setback on the <br />property generally known as 6070 143rd Lane NW and legally described as follows: <br />Lot 6, Block 2, Cedar Hills, Anoka County, Minnesota <br />(the "Subject Property") <br />2. That the Permittee appeared before the Planning Commission for a public hearing <br />pursuant to Section 106-220 (Variances) of the Ramsey City Code on November 30, 2023, <br />and that said public hearing was properly advertised and that the minutes of said public <br />hearing are available. <br />3. That the Subject Property is approximately 0.25 acres in size, which is similar to other <br />residential properties in the immediate surrounding neighborhood. <br />4. That the Subject Property is zoned R-1A, Single -Family Residential District. <br />5. That the parcels to the southwest, west, north, and east of the Subject Property are also <br />R-1A, Single -Family Residential District, and the parcel to the southeast of the Subject <br />Property is zoned P, Parks and Open Space. <br />6. That the Subject Property is guided as Low Density Residential in the 2040 <br />Comprehensive Plan. <br />7. That City Code Section 106-450(C)(2) (Accessory Structures) specifies that accessory <br />structures shall be no closer to the street than the edge of the principal structure. <br />8. That the Accessory Structure is located within the front yard and is closer to the front lot <br />line than the principal structure. <br />9. That the Subject Property is located on the inside of a curve in the 143rd Lane NW right- <br />of-way, creating a pie -shaped lot with a larger front yard and a smaller rear yard. <br />10. That due to the unique slope and drainage patterns of the Subject Property, an Accessory <br />Structure would not be able to fit in the rear or side yards of the property. <br />11. That there is no flat area in the rear yard of the Subject Property that would be sufficient <br />to place the Accessory Structure without impeding drainage. <br />
