Absent: Board Members Nixt and Wivoda. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to Side Yard Setback Requirements; Case of Michael <br />Gobernatz <br /> <br />Chairperson Anderson closed the regular portion of the Board of Adjustment meeting at 7:08 <br />p.m. in order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Chairman Anderson called the public hearing to order at 7:08 p.m. <br /> <br />Presentation <br /> <br />Zoning Administrator Frolik stated that City Code states that in the Rural Residential district, <br />structures shall not be located closer than 10 feet to the side property line. Michael Gobematz <br />resides at 5900 177th Avenue Northwest and is requesting a variance to construct a detached <br />garage that is proposed to be located six feet from his west side property line. <br /> <br />Zoning Administrator Frolik explained that the parcel is 2.5 acres in size and the addition of the <br />garage to the property is within the square footage allotment for garages on a parcel of this size. <br />She stated that Mr. Gobernatz is proposing to locate the garage six feet from his west side <br />property line. The site plan submitted and an on-site inspection confirm the sharp declines in <br />topography restrict Mr. Gobematz' options to locate a second garage on his property. She stated <br />that there is also a ten foot wide drainage and utility easement along the west property line that <br />should not be encroached upon by structures. Mr. Gobematz has applied for an easement <br />vacation to vacate five feet of that 10 foot easement to facilitate the proposed placement of the <br />new garage. Zoning Administrator Frolik noted that City Staff has determined that there was no <br />particular reason that a ten foot versus the standard five foot easement was dedicated on the plat. <br />Staff is assuming that the plat was drawn with ten foot easements and because there is a ten foot <br />structure setback, it probably wasn't cost effective to have the final plat mylars redrawn to reduce <br />the drainage easement to five feet. She explained that the request for easement vacation was <br />presented to the City Council for action on May 25 with Staff's support. The City Council <br />introduced an ordinance to vacate five feet of the ten foot easement and the ordinance will be <br />presented to the City Council for final adoption on June 8. Zoning Administrator Frolik noted <br />that Council will not vacate five feet of the easement if the variance of the side yard setback is <br />not granted. <br /> <br />Citizen Input <br /> <br />None. <br /> <br />Board of Adjustment/June 1, 1999 <br /> Page 2 of 4 <br /> <br /> <br />
