2) Board of Adjustment public hearing and special meeting minutes dated June 8, 1999.

Motion carried. Voting Yes: Chairperson Anderson, Board Members Jensen, Kociscak,
Dempsey, Johnson, Nixt, and Wivoda. Voting No: None.

PUBLIC HEARINGS/BOARD BUSINESS

Case #1: Request for Amendment to Variance; Case of Terrance Belschner

Chairperson Anderson closed the regular portion of the Board of Adjustment meeting at 7:04
p.m. in order to conduct the public hearing.

Public Hearing

Chairperson Anderson called the public hearing to order at 7:04 p.m.

Presentation

Zoning Administrator Frolik stated that on April 6, 1999, the Board of Adjustment granted the
Belschner's a variance to construct their garage closer to the front property line than their home
at 7319 162"a Lane Northwest. The exhibit that the Belschner's submitted identified that the
garage would be 40 feet from the front property line. This measurement was in error; the
measurement was taken from the pavement edge, not the property line. The actual distance from
the proposed garage to the front property line is 25 feet.

Zoning Administrator Frolik explained that the proposed garage will be built in the same location
proposed in April, but it is necessary to amend the distances in the Findings and Variance. City
Staff recommended rescinding the previous resolutions adopting findings of fact and variance,
and adopting new resolutions with the correct measurements.

Citizen Input

None.

Motion by Board Member Dempsey, seconded by Board Member Jensen, to close the public
hearing.

Motion Carried. Voting Yes: Chairperson Anderson, Board Members Dempsey, Jensen,
Johnson, Kociscak, Nixt and Wivoda. Voting No: None.

The public hearing closed at 7:05 p.m.

Board Business

Board of Adjustment/July 6, 1999
