Community Development Director <br /> <br />Background: <br /> <br />Sweetbay Ridge, former gun club property, received preliminary plat approval on August 23, 2005. <br />One significant contingency of the preliminary plat approval was that the Developer could not <br />submit an application for final plat approval until MPCA issues a Certificate of Completion for the <br />site clean up. Site clean-up is anticipated to be complete in mid-June, with the completion report <br />being submitted to MPCA by June 30. Bemuse of workload and staffing constraints, MPCA <br />estimates that a Ceaificate of Completion may take up to 60 days to process. <br /> <br />The Developer also wants to start grading prior to final plat approval in order to get <br />infrastructure in the ground during this construction season. The Developer is hoping to be <br />able to pull some building permits for Brookfield before the end of the year. The installation <br />of water main improvements through Sweetbay is critical to Brookfield, since adequate fire <br />protection would not be available in Brookfield without the watermain looping. <br /> <br />Attachments: <br /> <br />a) Site location map <br />b) Preliminary plat <br /> <br />Action Statement: <br /> <br />Oakwood is seeking direction as to what, if any, documents could the Developer supply to give <br />Council a level of comfort at which they would consider allowing the Developer to apply for final <br />plat approval. If Council allowed for the application to occur prior to receipt of the Certificate of <br />Completion, the plat would most likely be ready for Council review on August 8. It is anticipated <br />that the MPCA Certificate of Completion will be available sometime in August also. To wait until <br />after the Certificate is received to accept an application for final plat approval pushes the Council <br />review date out to the end of September in the best case scenario. <br /> <br />As for the grading, the City has in previous cases entered into a Grading Agreement with <br />developers provided the final grading plans have been reviewed and approved by Engineering; all <br />necessary permits, such as WMO and MPDES, have been obtained; a cash escrow for inspection <br />fees has been provided; and a financial surety for the grading operations has been established. <br /> <br />CCWS: 06.06.06 <br /> <br /> <br />
