Written documentation from thc U.S. Fish and Wildlife Service or applicable <br />2 government agency, documenting that thc proposed site -gill not interfere with <br />3 migratory bird patterns. <br />4 •c. Before thc issuance of a building permit, the following supplemental information shall <br />5 c submitte4 <br />6 i. Affirmation that the proposed WECS will comply with any applicable regulations <br />7 &dministcred by the Federal Aviation Administration; and <br />8 ii. A report from a qualifi-ed and licensed professional engineer which demonstrates <br />9 the compliance of the WECS with the aforementioned structural and electrical <br />10 but not radio frequency) standards. <br />11 {i) Electrical standards arc set by state statue/law and inspected by the state electrical <br />12 inspector. <br />13 iii. Certificate of insurance for thc WECS. <br />14 {13) Conditional use permit required. Except as otherwise provided for in this section of thc Code, it <br />15 shall bc unlawful for any person, firm, or corporation to erect, construct in plaec, place or re <br />16 erect, or replaec any WECS without first making application to the city council and -securing -a <br />17 conditional use -permit therefore as he-einafter provided. Routine maintenance of the WECS <br />18 and related structures shall not require thc issuance of a conditional use permit. <br />19 (14) Violations. Any person who shall violate any of thc provisions of this. Section shall be guilty-ef-a <br />20 misdemeanor. <br />21 {15) Existing WECS. Any WECS in existence as of the effective date of the ordinance from which this <br />22 section derives, which do not conform to or comply-w+th this section of thc Code arc subject to <br />23 thc following provisions: <br />24 a. The WECS may-eontinuc in use or thc purpose now used and as now existing -but may not bc <br />25 replaced or materially altered without comply in all respects with this Jccti-on. <br />26 b. If such WECS arc hercifter damaged or destroyed due to any reason or cause whatsoever, <br />27 the WECS may bc repaired and rcstorcd to its former use, location, and physical dimensions <br />28 upon obtaining a building permit therefor, but without otherwise complying with this section, <br />29 provided, however, that if thc cost of repairing the WECS to its former use, phys <br />30 dimensions, and location would exceed 50 percent of thc cost of a new WECS of like kind and <br />31 quality en the WECS may not bc repaired or rcstorcd except in full compliance with this <br />32 section. <br />33 <br />34 332 Solar energy systems <br />35 In all districts, solar energy systems shall be permitted as an accessory use in accordance with the <br />36 standards in this section. <br />37 (A) Exemptions. Passive or building -integrated solar energy systems are exempt from the requirements <br />38 of this section and shall be regulated as any other building element. <br />39 (B) Standards. <br />40 (1) Wall -Mounted or Roof -Mounted Systems <br />41 a. Building -mounted solar energy systems shall eomply with all building setbacks in the <br />42 applicable zoning -district and shall not extend beyond the perimeter of the building on <br />43 which the system is mounted unless the mounting system has been explicitly engineered <br />44 to safely extend beyond the edge. <br />45 b. Building -mounted solar energy systems shall be included eomply with the maximum <br />46 allowable building height for the applicable zoning district. <br />47 (2) Ground -Mounted Systems <br />7 <br />
