1 4. Covenants or other equally effective legal instruments must be developed that specify <br /> 2 which lot owners have authority to use the access lot and what activities are allowed.The <br /> 3 activities may include watercraft launching, loading, storage, beaching, mooring, or <br /> 4 docking. They must also include other outdoor recreational activities that do not <br /> 5 significantly conflict with general public use of the public water or the enjoyment of <br /> 6 normal property rights by adjacent property owners. Examples of the non-significant <br /> 7 conflict activities include swimming, sunbathing, or picnicking. The covenants must limit <br /> 8 the total number of vehicles allowed to be parked and the total number of watercraft <br /> 9 allowed to be continuously moored, docked, or stored over water, and must require <br /> 10 centralization of all common facilities and activities in the most suitable locations on the <br /> 11 lot to minimize topographic and vegetation alterations.They must also require all parking <br /> 12 areas, storage buildings, and other facilities to be screened by vegetation or topography <br /> 13 as much as practical from view from the public water, assuming summer, leaf-on <br /> 14 conditions. <br /> 15 (F) Placement, design, and height of structures. <br /> 16 (1) Placement of structures on lots. When more than one setback applies to a site, structures and <br /> 17 facilities must be located to meet all setbacks. Where structures exist on the adjoining lots on <br /> 18 both sides of a proposed building site, structure setbacks may be altered without a variance to <br /> 19 conform to the adjoining setbacks from the ordinary high water level, provided the proposed <br /> 20 building site is not located in a shore impact zone or in a bluff impact zone. Structures shall be <br /> 21 located as follows: <br /> 22 a. Structure and on-site sewage system setbacks(in feet)from ordinary high water level*. <br /> Classes of Public Waters Structures Setbacks* <br /> Unsewered Sewered Sewage Treatment <br /> System <br /> Lakes <br /> Natural environment 150 150 150 <br /> Recreational development 100 75 75 <br /> General development 75 50 50 <br /> Tributary streams 100 50 75 <br /> 23 <br /> 24 *One water-oriented accessory structure designed in accordance with subsection (f)(2)of <br /> 25 this section may be set back a minimum distance of ten feet from the ordinary high water <br /> 26 level. <br /> 27 b. Additional structure setbacks. The following additional structure setbacks apply, regardless of <br /> 28 the classification of the water body: <br /> Setback From: Setback <br /> (in feet) <br /> Top of bluff 30 <br /> Unplatted cemetery 50 <br /> Right-of-way line of federal, state, or county highway 50 <br /> Right-of-way line of town road, public street, or other roads or streets not classified 20 <br /> 29 <br /> 30 c. Bluff impact zones. Structures and accessory facilities, except stairways and landings, must <br /> 31 not be placed within bluff impact zones. <br /> 32 d. Uses without water-oriented needs.
