Any area which will be physically altered from its natural state. This will include all areas of <br /> grading, utility installation, building pads, driveways, and parking areas. <br /> Drip Line <br /> The farthest distance away from the trunk of a tree that rain or dew will fall directly to the ground <br /> from the leaves or branches of the tree or 1 foot per 1 inch of diameter, whichever is greater. <br /> New Development <br /> A piece of property that is being platted for the purpose of establishing urban residential use with <br /> two or more dwelling units, establishing a business use, or is being improved by grading which <br /> requires a grading permit. This definition does not apply to agricultural lot splits or to public <br /> street/utility projects. <br /> Property Owner <br /> The owner of a buildable property who is constructing or expanding a dwelling or a business on <br /> that property. <br /> a. Common Tree <br /> Adeciduous overstory tree including cottonwood, poplars/aspen, box elder, willow, silver <br /> maple, elm, and any other tree species not defined as hardwood deciduous tree or a <br /> coniferous/evergreen tree or considered non-native to Minnesota. <br /> b. Coniferous/Evergreen Tree <br /> A tree that bears cones and evergreen needle-like or scale like leaves year-round which <br /> reaches a height of at least 15 feet at maturity. <br /> c. Deciduous Tree <br /> A woody tree which has a defined crown, and which loses leaves annually. <br /> d. Hardwood Deciduous Tree <br /> Includes ironwood. catalpa, oak, maple (hard), walnut, ash, hickory, birch, black cherry, <br /> hackberry, locust and basswood. <br /> e. Heritage Tree <br /> A healthy hardwood deciduous tree measuring equal to or greater than 27 inches in diameter <br /> or a healthy coniferous evergreen tree greater than 50 feet in height. <br /> f. Nuisance or Hazard Tree <br /> 1. Any living or standing tree or part thereof infected to any degree with a shade tree <br /> disease or shade tree pest unless properly treated under the direction of a professional <br /> arborist/forester. <br /> 2. Any logs, stumps, branches, firewood, or other part of dead or dying trees infected with a <br /> shade tree disease or shade tree pest. <br /> 3. Any standing dead or living trees or limbs which may threaten human health or property. <br /> g. Protected, Preserved or Undistributed Tree <br /> Any tree with no less than, 60% of the critical -soot zone left mdisturbed or winch has been <br /> protected during the construction process by the tree protection methods described therein. <br /> h.
