City Engineer Jankowski gave a brief description of the original grading plan, but noted that
Orrin Thompson Homes will need permission from all of the property owners to re-grade their
yards.

Councilmember Hendriksen advised the property owners to grant the access to Orrin Thompson
Homes in order for the problem to be corrected.

Wanda Tanksi, 15781 Lithium Street NW, Ramsey, stated that she paid for a retaining wall to be
installed as directed by Orrin Thompson Homes and if the property is brought back to its original
grade the retaining wall will no longer be necessary.

Director of Public Works Kapler explained that the property will be brought back to what was
originally approved by the City and any costs that the property owners have incurred should be
covered by Orrin Thompson Homes.

Councilmember Hendriksen stated that Orrin Thompson Homes needs to come to an agreement
with the other affected property owners and bring the agreement back to the City before the City
begins to issue building permits.

Councilmember Connolly suggested holding funds to verify the project is completed correctly.

Director of Public Works Kapler replied that holding of funds was included in the agreement.

Kristine Booth, 15791 Lithium Street, NW, Ramsey, inquired as to how the residents will know
what the original grade is suppose to be.

Councihnember Hendriksen replied that there is a plan filed with the City that they could review.

City Engineer Jankowski stated that he would be willing to draw out the original contours or
mark their yards.

Councihnember Hendriksen stated that he thinks the situation needs to be resolved and that the
agreements with the other affected property owners should be signed by each owner and include
covering all costs that were incurred by the property owner.

Councilmember Connolly suggested notifying On:in Thompson Homes that the agreement is
acceptable, but they also need to get signed agreements from all other affected property owners.

Director of Public Works Kapler replied that Orrin Thompson Homes is already required to do
SO.

Councihnember Hendriksen stated that the City Attorney needs to inform Orrin Thompson
Homes that there are still agreements that need to be made.

Public Works Committee/December 21, 1999
